26/02165/TPC - Tree Works in Conservation Area Awaiting decision

Proposal

The silver birch is approx 15m tall. The top 50% is dead including the main trunk. The tree has been crowded out and starved of water and light for some years. The single remaining main live branch grows out north-west at an angle. This is now growing over the end of the driveway so presents a future risk to people/cars below. We have consulted an arborist/surgeon (James at Higgins Tree and Land Management). He previously did a fantastic job on a nearby yew on same boundary. He recommends removal of birch. Reduction work has already been applied for adjacent Yew which in on next door property, 48B High Street. (T1 on plan: application no: 26/02074/TPC refers.) This tree is currently causing overall light deprivation to all nearby trees as well as cottage. The adjacent trees (copper beech, beech, hornbeam) were planted as a mixed hedge by looks of it when houses built and were not tended when young so have now all outgrown their space. Site constraints 8

North Wessex Downs National Landscape
Great weight to conserving the landscape; major development restricted.
Previously an area of outstanding natural beauty, which is still the designation in law. Since 2023 authorities must seek to further its purpose, not merely have regard to it.
Kintbury conservation area
Demolition needs planning permission and permitted development is restricted.
The council must give weight to preserving or enhancing the area's character and appearance. Not every council has published its boundaries as open data.
Public footpath 25 m away
Matters where it crosses or adjoins the site: obstructing a path without a diversion order is an offence, and work cannot start until the order is confirmed.
Compiled from highway authority data, not the legal definitive map. A few authorities have not published, so no path shown is not proof there is none.
Habitat network: Network Enhancement Zone 2
Where habitat is joined up enough to work as a network. Context, not a constraint on its own.
Also on the record
Radon affected area, class 2; SSSI 328 m away: Bowdown and Chamberhouse Woods SSSI; Inside the Kintbury built-up area; Natural England's Provisional ALC map (1:250,000, 1970s) had this area as grade 2, but it predates the buildings here and the current map does not class it as farmland.
Not affected
Outside flood zones 2 and 3 · Not green belt · No listed building at the site

Checked on 6 October 2026. Historic England, the Environment Agency, Natural England, the British Geological Survey and UK Health Security Agency (radon, contains BGS materials © UKRI) and council datasets, Open Government Licence. A boundary can run through a site and the council holds the definitive record: confirm with the council before relying on this.
