What is a Tree Preservation Order (TPO)?
A legal order made by a local council to protect specific trees from being cut down, lopped, topped, uprooted or wilfully damaged without consent. Breaching a TPO can lead to unlimited fines and a criminal record.
Do you need permission to cut down a tree in a Conservation Area?
You must give the council 6 weeks' notice (a Section 211 notice) for any works to trees with a trunk diameter over 75mm in a Conservation Area. During those 6 weeks the council may make a Tree Preservation Order if they want to protect the tree permanently.
How do I object to tree works?
Submit comments via the council's planning portal during the consultation period (usually 21 days). Material considerations include the tree's amenity value, ecological role, the proposed reason for the work, and any TPO or Conservation Area status.
