26/02179/TPC - Tree Works in Conservation Area Awaiting decision

Proposal

I wish to apply to fell and dismantle the mature Cedar of Lebanon tree, known as tree icon 014J in the grounds of St Mary's Church yard, Shaw. The tree has had two significant and large limb rip outs over the last threee months from probalby included bark and acute branch collars, the remaining tree has several more significant limbs with similar branch collars and the concern is that additional limbs and branches are likely to fall over time. A well used footpath runs past the tree and this is used daily by children and adults. The tree now has two large decay points where the limbs ripped out from so these will be sites of pathogen ingress over time. The tree is around 15m in height and 10-12m in width, the hope is that the church plants a replacement tree elsewhere in the churchyard. Data via plota.co.uk

Site constraints 11

Grade II listed: Parish Church of St. Mary
List entry 1291032 · The pin is inside its outline · 6 more listed buildings within 150 m (1 Grade I, 5 Grade II)
Listed building consent is needed for work that affects the special interest of a listed building, inside or out, on top of planning permission. Setting can be a consideration for buildings nearby; there is no fixed radius.

Historic England ↗
Nutrient neutrality catchment: River Lambourn SAC
New homes and overnight accommodation must show nutrient neutrality before approval.
Natural England advice: extra wastewater in these catchments harms protected habitats, so schemes must offset their nutrient load, usually through credits.
Registered park or garden: Shaw House
Nationally designated heritage. Its significance and setting carry great weight.
Registered parks and gardens, battlefields, world heritage sites and protected wrecks are designated heritage assets: harm needs clear and convincing justification.

Shaw House and Church conservation area
Demolition needs planning permission and permitted development is restricted.
The council must give weight to preserving or enhancing the area's character and appearance. Not every council has published its boundaries as open data.
Heritage at risk: Shaw House
On the register of historic places assessed as at risk.
A designated building, monument, park or conservation area assessed as at risk from neglect, decay or development. Proposals that secure its future are looked on favourably.
Historic England ↗
Special area of conservation 76 m away: River Lambourn
Work nearby can need a habitats assessment.
Harm to a protected site is only accepted where there is no alternative and an overriding public interest.
SSSI 76 m away: River Lambourn SSSI
Natural England may need consulting, depending on what is proposed.
Sites of special scientific interest are the best wildlife and geological sites in the country. Development likely to harm one is rarely permitted.
Habitat network: Wood pasture and parkland
Where habitat is joined up enough to work as a network. Context, not a constraint on its own.
Also on the record
Radon affected area, class 2; Inside the Newbury built-up area; Priority habitat 44 m away: Deciduous woodland.
Not affected
Outside flood zones 2 and 3 · Not green belt · No scheduled monument at the site

Checked on 7 October 2026. Historic England, the Environment Agency, Natural England, the British Geological Survey and UK Health Security Agency (radon, contains BGS materials © UKRI) and council datasets, Open Government Licence. A boundary can run through a site and the council holds the definitive record: confirm with the council before relying on this.
