Summary of planning committee decision
Decided by Thanet Planning Committee on 18 Feb 2026.
What was proposed
Retrospective permission was sought for alterations to the dwelling, rear garden boundaries, barbecue and outbuilding roof and trellis.
“The application seeks retrospective planning permission for various works to the dwelling, the outbuilding within the rear garden and the boundary treatment to the rear garden.”
“Timber trellis has been installed on the rear garden walls, and a brick BBQ installed within the rear garden. A new roof has been installed within the existing outbuilding, and wooden trellis added to the edge of the roofing.”
Officer report
The site
The property is a four-storey terraced single dwelling with a rear garden and outbuilding, within a listed terrace and conservation area.
“Hawley Square is a four storey terraced dwelling, with a basement, located on the southern side of Hawley Square within the centre of Margate. The property is in use as a single dwelling, and features black railings to the front of the property, and a private garden to the rear, with an outbuilding located at the end of the garden. An alleyway runs along the rear of the property.”
“The property, along with the others in the terrace, is Grade ll listed, and also lies within Margate Conservation Area.”

Consultation and objection
One objection questioned the plans, alleged privacy loss from roof access and raised a fire-risk concern about the barbecue.
“Letters were sent to the neighbouring occupiers, a site notice was posted near the site and the application was advertised in the local press. One objection was received and its contents summarised below:”
“Plans of outbuilding and associated trellis submitted as part of this application and approved as part of application L/TH/25/0325 do not match the height of the outbuilding and trellis as constructed on site. • Plan showing the rear elevation of the outbuilding is required. • Neighbours have experienced direct overlooking of privacy loss as the potted plants on the roof of the outbuilding require regular maintenance.”
Officer report
Privacy and roof use
Officers found the roof was used for plants and art, not as a terrace, and proposed restricting it to access and maintenance.
“Concern has been raised by a neighbour regarding overlooking from the roof of the outbuilding, which they contend is being used as a roof terrace. Site visits conducted by various members of the planning department, including the case officer, confirmed that the roof of the outbuildings is used solely for the placement of plant pots and art pieces, and whilst the applicant does regularly access the roof to water the plants, this is not the same as creating a formal terrace.”
“The objector has requested that cross section drawings are provided, to demonstrate the overlooking impact to her property and rear garden. However these drawings are not considered necessary. It is clear that if the roof was to be used as a roof terrace, due to its elevated height views into neighbouring gardens and properties would be possible and result in harm to neighbouring privacy, however, this application is not seeking permission to use the roof in this way, and…”
