26/02180/TPC - Tree Works in Conservation Area Awaiting decision

Proposal

I would like to carry out a crown lift on this mature willow tree growing on private land and to the side of the public footpath and adjacent to 25 Lambourn Place, Lambourn. The branches currently hang to around 1.5m over the footpath and the intention is to crown lift the branches to 2.5m over the footpath. In addition there is a partially broken and partially hanging branch within the low crown of the tree and I will instruct the contractor to prune this off, leaving arisings on site, in order to mitigate the risk to the public. Site constraints 13

Nutrient neutrality catchment: River Lambourn SAC
New homes and overnight accommodation must show nutrient neutrality before approval.
Natural England advice: extra wastewater in these catchments harms protected habitats, so schemes must offset their nutrient load, usually through credits.
North Wessex Downs National Landscape
Great weight to conserving the landscape; major development restricted.
Previously an area of outstanding natural beauty, which is still the designation in law. Since 2023 authorities must seek to further its purpose, not merely have regard to it.
Lambourn conservation area
Demolition needs planning permission and permitted development is restricted.
The council must give weight to preserving or enhancing the area's character and appearance. Not every council has published its boundaries as open data.
Tree preservation order: 201/21/0120 - A1
Consent is needed before work on protected trees.
Not every council has published its orders as open data, so no order shown is not proof there is none.
Public footpath 21 m away
Matters where it crosses or adjoins the site: obstructing a path without a diversion order is an offence, and work cannot start until the order is confirmed.
Compiled from highway authority data, not the legal definitive map. A few authorities have not published, so no path shown is not proof there is none.
Special area of conservation 132 m away: River Lambourn
Work nearby can need a habitats assessment.
Harm to a protected site is only accepted where there is no alternative and an overriding public interest.
Scheduled monument 92 m away: Lambourn Cross
Its setting is a consideration for work nearby.
Nationally important archaeology protected by the Secretary of State. Work that affects the monument or its setting is rarely permitted.

26 listed buildings within 150 m
Nearest: Garden Walls to South East and South West of Former Site of Lambourn Place, and on Either Side of Lambourn Place Gateway, and Running Along Chapel Lane, Grade II, 24 m away · 1 Grade I, 2 Grade II*, 23 Grade II
The site itself is not listed. Listed building consent is needed for work that affects the special interest of a listed building, inside or out, on top of planning permission. Setting can be a consideration for buildings nearby; there is no fixed radius.

Historic England ↗
Habitat network: Network Enhancement Zone 2
Where habitat is joined up enough to work as a network. Context, not a constraint on its own.
SSSI 132 m away: River Lambourn SSSI
Natural England may need consulting, depending on what is proposed.
Sites of special scientific interest are the best wildlife and geological sites in the country. Development likely to harm one is rarely permitted.
Also on the record
Radon affected area, class 2; Inside the Lambourn built-up area; Natural England's Provisional ALC map (1:250,000, 1970s) had this area as grade 2, but it predates the buildings here and the current map does not class it as farmland.
Not affected
Outside flood zones 2 and 3 · Not green belt

A boundary can run through a site and the council holds the definitive record: confirm with the council before relying on this.
