Retrospective decked area at Rose & Crown, High Street, Elham, Canterbury

Summary of planning committee decision

Decided by Shepway Planning and Licensing Committee on 11 Nov 2025.

22/1846/FHApproved

What was proposed

Retrospective listed building consent was sought to retain a raised timber deck extending the public house’s rear outdoor seating area.

“The property has manager’s accommodation on the first floor and benefits from an existing external paved patio area to the rear, accessed through the bar area. The decked area, the subject of the application, leads from this and sits between the rear of the public house and the boundary wall of The Old Bookshop. It is divided by a hedge.”

“A site location plan is attached to this report as Appendix 1. Proposal 3.1. This application seeks retrospective listed building consent to retain a raised, timber decking area that has been constructed to extend the outdoor seating area associated with the rear of the public house.”

Officer report

The site and surroundings

The site is a Grade II listed public house in the Elham conservation area and Kent Downs National Landscape, with a rear patio, decking and parking.

“The application property consists of the Grade II listed public house (The Rose & Crown), which is within the defined settlement boundary of Elham, within the Kent Downs National Landscape, and the designated Elham conservation area. The building is a traditional timber-framed building, spanning two-storeys and a basement, that dates back to the 15 th or 16 th Century, was rebuilt and altered in the 17th Century, with 19 th century alterations and fenestration.”

Officer report

The officers’ assessment

Officers considered that the low-level timber decking affected little historic fabric and caused no harm to the listed building or nearby listed structures.

“As the property is Grade II listed, section 16(2) of the Planning (Listed Buildings and Conservation Areas) Act 1990 requires special regard to be had to the desirability of preserving the Listed Building or its setting or any special architectural or historic features it possesses.”

“Beginning with the impact upon the significance of the listed building, the fabric of the building is largely unaffected, other than the decking being attached to the external element of the building at ground floor level, and the decking has neither removed nor obscured any features of historic significance.”
