The dwellinghouse sits in a very large plot of some 0.46 hectares and stands prominently on elevated ground some 20m back from the highway. The land rises up quite considerably from the highway with an existing private drive extending up in a steep gradient along part of the site’s northern boundary, adjacent to a high stone boundary wall.”
“The appeal was refused on highway safety grounds with the Inspector stating that the main issue was the gradient of the proposed access which ran straight towards Loxley Road and was stated as not being safe in winter conditions (snow and ice) that could lead to the potential for vehicles to skid thereby endangering users of Loxley Road. The suitability of the site’s development for housing was established in principle.”
