25/00751/42MApproved

The site and wider development

The approximately 10-hectare site includes an existing poultry plant and proposals for a replacement facility, other employment uses, housing, access, parking and landscaping.

“Planning Permission in Principle was granted in August 2024 for a mixed use development comprising of the erection of a poultry processing facility and demolition of existing poultry processing facility for residential, commercial, industrial uses including parking areas, vehicular access, landscaping and associated works.”

“The proposal is for the demolition of the existing poultry processing plant and provide a new facility to the west, with further industrial, commercial and residential uses to the north of that. The new poultry processing plant will extend to approximately 28,000 sq/m and see parking, new vehicular accesses, landscaping and other works undertaken.”

Officer report

Why officers recommended approval

Officers considered the amendment consistent with the Development Plan because the approved flood strategy required floodwater storage and the revised condition remained effective.

“The principle of the wider development to which the application relates has been established through the approval of the Planning Permission in Principle 23/02134/IPM. The principle of the development is therefore established and is not reviewed as part of this S.42 application. The amendment of Condition 4 as noted above is not in itself contrary to the general terms of the Development Plan.”

“To conclude, the application must be determined in accordance with the Development Plan unless material considerations indicate otherwise. In this respect, the proposal is considered to comply with NPF4, and the adopted Local Development Plan 2 (2019). Account has been taken account of the relevant material considerations and none has been found that would justify overriding the Development Plan.”

Officer report

Consultation and representations

SEPA had no comment, flooding officers had no objection, and one representation raised vermin management and odour control.

“Scottish Environment Protection Agency – No comment. The proposal relates to a condition not requested by SEPA.”

“One representation was received relating to potential plans for vermin management and odour control. The plant will operate under a permit from SEPA and these matters will be controlled and enforced by SEPA within the permit conditions.”

Officer report

The committee decision

The committee granted the application subject to the listed conditions and informatives, with a Section 75 Agreement required before permission could be issued.

“Conditions 1. Application for the approval required by a condition imposed on this Planning Permission in Principle shall conform with the requirements of Regulation 12 of the Town and Country Planning (Development Management Procedure) (Scotland) Regulations 2013 and of Section 59 (2) and (3) of the Town and Country Planning (Scotland) Act 1997 as amended by Section 21 of the Planning etc.”

“Informatives 1. Additional groundwater monitoring should be carried out over a full calendar year to include both summer and winter periods. If there is any proposal to alter a route of an existing core path or right of way a further legal procedure is required. The granting of planning permission does not stop the continued right of public access along the existing core path or right of way.”
