17 homes and access at Land North Of Fen Lane, Dunston

Summary of planning committee decision

Decided by North Kesteven Planning Committee on 2 Jun 2026.

23/1462/OUTApproved

What was proposed

Outline permission was sought for up to 17 homes and a new vehicular access from Fen Lane, with other details reserved for later approval.

“The application seeks outline planning permission for the erection of up to 17 dwellings, with the formation of a new vehicular access from Fen Lane. At this outline stage, access is the only matter submitted for detailed consideration. All other matters (appearance, landscaping, layout and scale) are reserved for later detailed approval.”

Officer report

Earlier permissions and allocation

Earlier permissions covered five homes on part of the site, while the wider land is allocated for housing with an indicative capacity of 25 homes.

“Outline planning consent has previously been granted on a smaller parcel of the application site under applications 19/1434/OUT and 22/1170/OUT (the latter consent replacing the first, which had time-expired) for the erection of 5 dwellings.”

“Within the 2023 Central Lincolnshire Local Plan (CLLP) the site, together with the land immediately to the west (the recent 8 no. dwellings development), is formally allocated for residential development under policy S81 ‘Housing Sites in Medium Villages’ (allocation ref: NK/DUNS/001). The site allocation as a whole has an indicative capacity of 25 dwellings.”

Officer report

What officers recommended

Officers recommended approval subject to a legal agreement, affordable housing, healthcare funding and revised flood-mitigation conditions.

“Whilst there has been a change in the classification of flood zones on the site since the receipt, assessment and committee resolution in relation to these proposals, Officers are satisfied that through an updated FRA and additional detailed technical modelling data, sufficient information has been submitted to ensure that the site-specific risk of flooding on the site remains low.”

“Authority to deal and APPROVE subject to the completion of a s106 Agreement addressing the following heads of terms and subject to the revised condition 19 as listed below and with all other conditions as set out in the 8 th October 2024 Committee Report:”

Officer report

Flood risk changed

Updated flood mapping placed parts of the site in Flood Zones 2 and 3, but new modelling concluded that the actual development risk remained low.

“As set out above, on 25 th March 2025, whilst negotiations in relation to the S106 Agreement were advancing, the Environment Agency (EA) updated and published a new ‘national flood risk assessment’ (NaFRA2). This updated national FRA provides new modelling with higher resolution data and improved modelling techniques.”

“As a consequence of change to the flood risk status of the site, Officers contacted the EA to understand the implications of this in respect of their consultation advice at the time the application was presented to the Planning Committee.”

Officer report

What consultees said

The Environment Agency withdrew its objection after reviewing the updated assessment, subject to minimum floor levels and at least two-storey homes.

“The EA advised the District Council that the Flood Risk Assessment (FRA) submitted to support the application (Roy Lobley Consulting, ref: RLC/1436/FRA OSDS01, dated December 2023) is out of date following the publication of NaFRA 2 and does not include an appropriate assessment of the risk to the application site. Accordingly, objection is raised and it was advised that a further assessment of the risk from all sources of flooding needs be carried out through a revised FRA.”

“Accordingly, the previously raised objection has been withdrawn, subject to the imposition of a condition requiring development to be carried out in accordance with the submitted updated FRA with the following mitigation measures:”

Officer report

Residents’ concerns

Most original representations objected, raising flooding, foul drainage, neighbourhood-plan compliance, traffic, pressure on services, character and wildlife concerns.

“Concerns about the capacity of the existing foul sewerage system and that the sewerage undertaker has not remedied existing foul drainage problems in the village; • Concerns about recent surface water flooding in the area and the site and surrounding land having flooded in times of heavy rainfall; the proposals will increase the risks of flooding, putting people and property and risk (both existing and future residents) and sewage system outages will occur more frequently…”

“The proposal would place additional pressure on services and facilities and residents would need to access some facilities in Metheringham and which are therefore not conveniently located • Concerns regarding the increased level in traffic as a result of the development; there is a lack of off-road parking in the centre of the village meaning that in practice Fen Lane is a single lane environment for all traffic to and from the village • The proposals will adversely affect…”

Officer report

Who spoke

No public speakers or local ward members spoke on the update.

Members’ debate

Members considered the flood-zone change, the housing allocation’s planning weight, resilient construction, mitigation, drainage and the education contribution.

“Members then discussed the application, considering the Officer’s report and presentation. During the debate, Members raised the following points including: • The impact of the flood zone changes on the Central Lincolnshire Local Plan (CLLP) allocation of the site and whether this still carried significant planning weight in light of the flood zone changes.”

“The Applicant’s flood risk assessment response to the flood zone changes demonstrated that the site would be safe from flooding, as sufficient mitigation measures were proposed. • The exception test in terms of wider benefits had also been satisfied in relation to this site through delivery of affordable housing, BNG and accommodating the existing right of way through the indicative scheme design.”

The vote

Members voted nine for, none against and one abstention on delegated approval subject to the legal agreement and revised conditions.

“It was therefore proposed and seconded that planning permission be granted in line with the Officer recommendation and that Authority to Deal be given to Officers to approve under delegated powers upon the completion of a Section 106 Planning Agreement and amended Planning Condition 19, as well as the other Planning Conditions approved at the Planning Committee on Tuesday 8 th October 2024.”

“That Authority to deal and approve subject to the completion of a Section 106 Agreement addressing the following Heads of Terms and subject to the revised Condition 19 as listed below and with all other conditions as set out in the 8 th October 2024 Committee Report:”

Minutes

Flood conditions

The revised condition requires compliance with the updated flood assessment, minimum floor levels, two-storey homes and flood-resistance measures.

“The development shall be carried out in accordance with the submitted flood risk assessment undertaken by aegaea [ref: AEG8657_LN4_NorthKesteven_01b, Issue 5, dated 22 April 2026] and the following mitigation measures it details.”

“Finished floor levels shall be set no lower than stated in the FRA. • The development shall have at least two storeys. • The flood resistance and resilience measures shall be implemented as set out at section 5.4”
