35-home housing scheme at Land at Mountain Oak Farm, Lower Town, Sampford Peverell

Summary of planning committee decision

Decided by Mid Devon Planning Committee on 8 Apr 2026.

25/00304/MOUTApproved

What was proposed

An outline scheme sought permission for up to 35 homes, including two self-build plots, with only the access point fixed.

“Proposal: Outline application with all matters reserved, other than the point of access for the erection of up to 35 dwellings including two self-build plots…”

“The proposed development is an outline application with all matters reserved, other than the point of access for the erection of up to 35 dwellings including two self-build plots. The application is in partnership with the Sampford Peverell Community Land Trust with 10-12 affordable dwellings proposed.”

Officer report

The site

The site is outside the village settlement boundary, beside existing homes and agricultural land, and is not in a flood-risk area or conservation area.

“The application site is accessed from the Class III highway known as Lower Town via a private track which is within the applicant’s ownership. There are a number of existing dwellings on this part of Lower Town, mainly fronting the highway, with the main part of the application site to the rear of these dwellings. Whilst not within the defined settlement of Sampford Peverell, the settlement boundary is less than 90m to the west of the application site.”

Officer report

Earlier applications

Earlier outline applications for residential development and individual homes were refused, while agricultural and holiday-related schemes were permitted.

“08/01607/FULL - PERMIT date 24th October 2008 Erection of a two storey holiday unit and erection of stable block - HOLIDAY OCCUPANCY CONDITION APPLIES”

Officer report

Who spoke

An objector, the applicant, a parish council representative and two ward members addressed the committee, with one ward member’s statement read by the chair.

What members debated

Members discussed social-rent housing, the legal agreement, parking, speed limits, utilities, drainage, sewage and the consequences of a power outage.

“The S106 and the need for social rent affordable housing. • Whether it was possible to reduce the speed limits and parking restrictions? It was explained that this was a general issue in the village and not as a result of this particular planning application. • If there had been any concerns raised with regard to the National Grid and whether there was enough capacity to provide for the additional homes? It was confirmed that no concerns had been raised.”

To also amend condition two to reduce the time scale from three years to two and a half years for the application of Reserved Matters to be submitted to the Local Planning Authority from the date of this permission.”
