Short-term let accommodation at 3F2 62 Thistle Street, Edinburgh

Summary of planning committee decision

Decided by Edinburgh Development Management Sub-Committee on 1 Oct 2025.

25/00968/FULSTLRefused

What was proposed

The application sought retrospective permission to change a two-bedroom flat from residential use to short-term let accommodation, with no physical changes.

“/00968/FULSTL Site Description The application site is a two bedroom, third floor flat at 62 (3F2) Thistle Street in the city centre. The property shares its access to the street via a communal stair. There are retail units on either side of the main entrance door. Thistle Street is of mixed character, with a wide range of uses in the street, including offices, public houses, restaurants, shops and residential properties.”

“The planning statement highlights that the 'applicant seeks formal permission to continue to allow utilisation of the property as short-stay accommodation for up to 90 days per calendar year on a rolling basis subject to a 14 day minimum stay.' The description of development in the application form is for 'Retrospective change of use of premises to short term let accommodation.' This is what the application is being assessed on.”

Officer report

What officers advised

Officers recommended refusal because the short-term let would harm neighbouring amenity and the loss of residential accommodation was not justified.

“/00968/FULSTL Development Management Sub-Committee Report Wednesday 17 September 2025 Application for Planning Permission STL 3F2 62 Thistle Street, Edinburgh, EH2 1EN Proposal: Retrospective change of use of premises to short term let accommodation.”

“Whilst it is recognised that there is an economic benefit to the City as a whole from the provision of tourist accommodation, in this case it does not outweigh the adverse impact on residential amenity or the loss of residential accommodation. The proposal does not comply with the Development Plan Policy NPF 4 policy 30(e) and LDP Policy Hou 6. There are no material considerations that outweigh this conclusion. The proposal is unacceptable. SECTION A – Application Background…”

Officer report

Public response

Twenty-four representations supported the application, citing economic benefits, licensing compliance and no negative effect on residential amenity.

“Licensing regime Comments received in support of the application highlight the licensing regime in place for the operation of STLs and outline conditions aimed at managing undue public nuisance and anti-social behaviour. Notwithstanding the licensing regime with its conditions in place for the ongoing management of the STL, the STL use within this building and context does not comply with development plan policies in respect of amenity for the reasons above.”

“/00968/FULSTL A total of 24 representations have been received. All are in support including a petition with 21 signatures. Whilst the petition has 21 names and addresses, there is a duplicate signature. It is noted that 14 of the petition signatories have also submitted comments in support. A summary of the representations is provided below: material comments-in support -Brings economic benefits. -There will be no negative impact on residential amenity.”
