Summary of planning committee decision

The site and its setting
The site is a two- and three-storey terraced building in Deal’s conservation area, with part of it Grade II listed and subject to an Article 4 Direction.
“This application relates to a two and three storey terraced building on a corner plot of High Street, Market Street and Middle Street, Deal. 82 and 84 High Street form a single shop unit on the ground floor with ancillary rooms at first and second floor levels above.”
Officer report
Earlier approval and changes
Members had previously resolved to grant a similar scheme, but the legal agreement was not signed; revised viability evidence and design changes led to reassessment.
“In December 2025 viability information in the form of a RIBA Stage 3 Cost Estimate Report was submitted which sought to evidence that the scheme could not viably deliver affordable housing on or off site. Further information was provided to support this position in February 2026. This viability evidence was reviewed by an independent viability consultant who concluded that the scheme cannot support on or off-site affordable housing.”
“- The obscure glazed balustrading to the second floor roof terraces to the northern elevation has been increased in height. - Solar panels are proposed to be installed to the majority of the flat roof area. - Internally the proposed basement area has been reduced in size to a store room and utility for Flat 1. - At ground floor, the layout of the bin store, communal hall and cycle store for Block A and B has been revised.”
Officer report
What officers recommended
Officers recommended approval because the revised scheme was compatible with the building, would not harm heritage significance, and independently tested evidence showed affordable housing was not viable.
“Overall, the proposed external alterations are considered to comprise minor alterations which maintain the design approach of the original scheme and are compatible with the host building. The heritage officer has raised no objections to the revised scheme, and recommends the reimposition of the previously suggested conditions, which will be secured.”
“The works are not considered to result in harm to the special character and appearance of the Conservation Area or the Listed Building, in accordance with Policies HE1 and HE2 of the Dover Local Plan and the NPPF.”
Officer report
What consultees and residents said
The town council and a third party objected over heritage, overdevelopment, cramped flats, fire escapes, soundproofing, flat standards and the need for more shops.
“Deal Town Council – Objection. This development is overbearing and the internal arrangement is excessively cramped. There is no evidence of sound proofing between flats and no adequate fire escapes. The development will also have a detrimental effect on the conservation area and is not in keeping with surrounding buildings.”
“- Fail to see how the proposal is compatible with the aims of the Conservation Area. - The extension is out of keeping with this part of Deal Town Centre. - Raise concerns with the standards of the flats. - There is no need for 5 more shops, there are several vacant shops in the town centre.”
Officer report
What members discussed
Councillors expressed disappointment about the lack of affordable housing, while members heard about sound insulation, contributions and Building Control’s role in fire escape requirements.
“Councillors J S Back and M J Nee expressed disappointment that there would be no affordable housing. Councillor Nee suggested that it had been a cynical move by the developer and an unnecessary one because the Committee was likely to have understood the first time round that the conversion of an old building would make the delivery of affordable housing unviable.”
