Carbon dioxide pipeline and AGI at Protos Resource Recovery Park, Ince

Summary of planning committee decision

Decided by Chester Planning Committee on 5 Aug 2025.

25/00952/FULApproved

What was proposed

A 690-metre carbon dioxide spur pipeline and West AGI would connect Protos emitters to the Ince AGI and HyNet storage network.

“The proposed West Above Ground Installation (AGI) and pipeline would connect to the Protos Carbon Capture Facility and up to 3 other potential industrial emitters at Protos, to transport captured carbon dioxide to the Ince Above Ground Installation. The captured CO2 would then be exported to the HyNet Northwest CO2 Transport and Storage Facility, for long term geologically secure storage in depleted gas fields in Liverpool Bay.”

“Carbon Dioxide Delivery Pipe: The pipe would transport captured CO2 from the ERF Carbon Capture Plan to the West AGI. • Carbon Dioxide Delivery Pipe Bridge: The CO2 pipe would be routed over the structural steel pipe bridge, approximately 8.2m in height, spanning over the West Central Drain and Protos internal access road (Road 4).”

Officer report

The site and surroundings

The site includes agricultural land and Protos, with the AGI planned on Plot 9B and the buried pipeline extending beneath Marsh Lane and grassland.

“The application site lies partially within agricultural land and partly within the boundary of the Ince Park Site, a Resource Recovery Park (RRP) known as ‘Protos’. Protos extends across approximately 134 hectares of land at Ince Marshes and has outline permission (the RRP permission) for an integrated waste re- processing and management facility, and an energy from waste facility to be developed on a ‘plot by plot’ basis, organized around principal infrastructure and a…”

“The Protos Above Ground Installation (known as West AGI) would be located within Plot 9b of Protos on an area of land currently used as a temporary construction compound and car parking for the Energy Recovery Facility (ERF) being built out on Plot 8.”

Officer report

Planning history

Protos has outline permission, while the Energy Recovery Facility and Carbon Capture Facility are approved; an earlier East AGI proposal was approved but not issued.

“Protos Energy Recovery Facility – Approved development (18/01543/S73 – APP/A0665/W/18/3213090), currently under construction and due to become operational in 2024. • Protos Energy Recovery Facility Carbon Capture Facility – Approved development (Application Number: 24/00261/FUL) • HyNet Strategic CO2 Transportation pipeline and Ince AGI – Consented • Above Ground Installation and new Carbon Dioxide Spur Pipeline to serve Protos Resource Recovery Park and ancillary…”

“Appeal decision ref. APP/ZO645/A/07/2059609 granted outline permission in August 2009 for a resource recovery park (RRP) now known as ‘Protos’. The RRP permission included an Integrated Waste Management Facility and Environmental Technologies Complex with a range of proposed uses including various resource recovery facilities as well as energy from waste uses and associated infrastructure and transport links including rail and dock infrastructure.”

Officer report

Objections and representations

One objection concerned temporary construction traffic using Ash Road through Encirc, and Ince Parish Council objected over ecological mitigation land.

“Biodiversity Officer – No objection subject to conditions/obligations as follows: Construction Environmental Management Plan ( to include measures from Habitat Regulations Assessment), 2. Dewatering Plan, Biosecurity Method Statement, Precautionary Working Method Statement, 3. Large Mammal temporary disturbance measures during construction / permeable large mammal fencing / managed soil heaps 4. Peat management plan, 5.”

“Highways Officer – No objection subject to conditions: Construction HGV’s numbers limited to that set out in Transport Statement, 2. Construction Traffic Route, A5117, Pool Lane, Grinsome Road, (CTR1) only, 3. Construction Traffic Management Plan.”

Officer report

What members debated

Members asked whether the pipe bridge would allow modern railway rolling stock beneath it without prejudicing planned rail infrastructure.

“Members raised the following Queries • Members were concerned about the interaction between this proposal and a proposal at July’s meeting regarding the requirement to provide rail access to the Protos site, which had been deferred.”

“Officers responded as follows • The height of the pipeline and pipe bridge has been designed to accommodate rail transport beneath it. This has been reviewed by the Applicant’s rail consultant. Further details are to be provided by condition to ensure that there would be no conflict with the proposal and the provision of the Protos rail infrastructure.”
