One new dwelling at 79 Melton Road, Burton on the Wolds

Summary of planning committee decision

Decided by Charnwood Plans Committee on 11 Dec 2025.

P/25/0489/2Approved

What was proposed

The application proposed one new dwelling, a detached triple garage for the existing dwelling, landscaping, a new access and gates.

“The application site comprises garden land to the side and rear of a detached dwelling and is just outside the Limits of Development for Burton on the Wolds. To the south and east of the site is a recently constructed group of 70 residential dwellings with agricultural fields further afield to the east. To the north and west of the site is the public highway.”

“This application seeks planning permission for the erection of one new dwelling, and a detached triple garage for the existing dwelling. The proposed dwelling would have an attached garage to the front. The front elevation of the dwelling would face to the northwest and there would be gables to the front and rear. Due to the design of the roof, the proposed dwelling would have different eaves and ridge heights throughout.”

Officer report

Earlier planning history

“Relevant Planning History Reference Description Decision & Date P/21/2014/2 Erection of dwelling and detached garage…”

“Approved 31 January 2022 P/21/2028/8 Approval of reserved matters in relation to appearance, landscaping, layout and scale pursuant to Outline Planning Permission Ref. P/19/0041/2, and discharge of conditions 1 (reserved matters), 5 (landscaping details), 10 (construction ecological management plan) and 11 (biodiversity net gain/ lighting/ bird/bat boxes) of Application Ref. Officer report

Consultation responses

The parish council made no comment, the tree officer had no objection subject to protection, and ecology issues could be addressed by a gain condition.

“It is suggested that options for offsite mitigation are sought. The old version of the PEA has been reissued with no amendments therefore my previous comment regarding GCN has not been addressed. Trees need protecting during construction, new supporting documents have been submitted but defer to the tree officer for comment.”

“Revised Comments: If the self-build element has been withdrawn then the gain condition will now apply, This means that the offsetting issue can be dealt with via the gain condition, and whilst we don’t have complete clarity we do know that the applicant has recognised the need for offsetting. In effect the gain condition could be discharged by them providing evidence of purchase of the correct number of units.”

Officer report

Neighbour comments

One letter raised questions about foundations, visibility, bedrooms, outbuildings, trees, views and overlooking.

“P/21/2014/2 - Erection of dwelling and detached garage – granted planning permission. Responses to publicity From Comments 1 Letter of representation has been received…”

“How deep will the footings be? • Will the chimney be visible above the trees? • Will it be a 5 bedroom? • What are the outbuildings for? • How close to the trees will the next dwelling be? • The view from a neighbours kitchen won’t be as good • Will the occupiers of the new dwelling be able to see into this neighbours garden from the 1 st floor bedroom?”
