Summary of planning committee decision
Decided by Ashfield Planning Committee on 23 Jul 2025.
What was proposed
The application sought outline permission, including access, for one self-build dwelling, with appearance, landscaping, layout and scale reserved.
“PROPOSAL Outline Application (Including Access) for Construction of One Self-Build Dwelling - All Other Matters Reserved…”
“The Application This is an application for outline application (including access) for construction of one self-build dwelling with all other matters reserved at Belle Ver Coxmoor Road, Sutton in Ashfield. The proposed dwelling would be sited on land immediately to the north of the existing dwelling. The site is situated within the countryside as designated under Policy EV2 of ALPR 2002. To the north, south and west there are a number of other residential properties.”
Officer report
Why approval was advised
Officers considered the proposal appropriate infill and unlikely to harm countryside openness, amenity or highway safety, subject to conditions.
“Policy EV2 (g) states that infill development which does not have an adverse effect on scale of character of the area comprises appropriate development. Given the pattern of the development along Coxmoor Road and having particular regard to residential buildings either side of the site, the proposal would occupy a gap in an otherwise developed frontage.”
“Conclusion Having reviewed the submitted information and comments received against all relevant policies and material considerations it is considered that the proposal is unlikely to have a detrimental impact on the openness of the Greenbelt, amenity and highway safety. As such conditional consent is recommended.”
Officer report
Residents’ concerns
Residents raised concerns about the sewer connection and access onto a busy road.
“Resident Comments • Raising concerns over the sewer connection. • Raising concerns over the access onto a busy road.”
Officer report
Who spoke
The agent addressed the committee about the drainage matter, and members could clarify points raised.
Committee consideration
A motion was moved and seconded to grant conditional consent in line with the recommendation and changes in the late items.
“This can be done by accessing our records at www.digdat.co.uk Severn Trent Water advise that even if our statutory records do not show any public sewers within the area you have specified, there may be sewers that have been recently adopted under The Transfer of Sewer Regulations 2011. Public sewers and Water mains have statutory protection and may not be built close to, or diverted without consent, consequently you must contact Severn Trent Water to discuss your proposals.”
“It was moved and seconded that conditional consent be granted, as per the officer’s recommendation contained in the report and including the changes outlined in the reported late items.”
