“This is a full planning application for the erection of 6 residential units on land to the South East of the existing Shire Hall building in Llangefni.”

Officer report

Why officers recommended refusal

Officers recommended refusal because the applicant had not completed the required Section 106 agreement despite sufficient time being given.

“Since the matter was approved, the applicant has failed to appoint a Solicitor and place funds on account for the legal team to draft up a S106. Sufficient time has been given for the applicant to appoint a solicitor; however, due to the length of time that has passed with no prospect of completing the S106 agreement the Local Planning Authority has no option but to recommend refusing the planning application due to the lack of completing the required S106 agreement.”

“Due to the length of time that has passed with no prospect of completing the S106 agreement the Local Planning Authority has no option but to recommend refusing the planning application due to the lack of completing the required S106 agreement.”

Officer report

What members debated

Members debated whether the application should remain approved despite the absence of a fixed policy deadline for completing the Section 106 agreement.

“Councill Kenneth P Hughes said that this application was approved in July, 2024 and the applicant has 5 years to start the development of the site. He noted that there is no policy stating that a S106 agreement must be signed at a fixed date and this is a matter opinion of the Planning Officer’s that the developer has had sufficient time to complete the S106 agreement. Councillor Hughes proposed that the approval of the application should be remain.”

“The Planning Development Manager responded that the application is unacceptable as the applicant has not completed the S106 legal agreement and a contribution towards affordable housing. Whilst there is no policy fixing a timeframe for agreement for a S106 agreement, allowing an endless period to fund the S106 agreement is unsustainable. The application is acceptable subject to the S106 agreement being signed.”

Minutes

The committee vote

A proposal to refuse the application was made, seconded and approved in accordance with the officers’ recommendation.

“Councillor Geraint Bebb, and a Local Member propose that the application be refused in accordance with the Officer’s recommendation. Councillor Jackie Lewis seconded the proposal of refusal of the application.”

Minutes

The decision

The application was refused because the required Section 106 agreement for affordable housing and embankment wall management had not been completed.

“(01) The applicant has failed to complete a Section 106 agreement in relation to the need to provide a financial contribution towards affordable housing and the need to provide a management and maintenance for the embankment wall between the proposed building and Afon Cefni. The proposal is therefore contrary to Policy PCYFF 1 and Policy TAI 15 of the Ynys Mon and Gwynedd Joint Local Development Plan.”
