“3.Proposal 3.1.The proposal seeks Outline consent for three dwellings with all matters reserved except for access. 4.Consultees Third Party Representations 25 representations of Objection raising the following material planning considerations: • Out of Character and vernacular of area/harmful impact to landscape • Lack of infrastructure • Land prone to flooding • Dwellings are too large • Development at other site been left in poor condition • Unsuitable location for construction…”

Officer report

Why officers supported it

Officers considered the proposal sustainable, policy-compliant overall and beneficial for housing supply, subject to conditions and mitigation.

“Other 7.38.It has been argued as to whether there is a need for further housing development within Burgh, however, there is no requirement for the applicant to evidence that housing is necessary in this location, and this would not make this proposal unacceptable as Policy SCLP5.3 allows for additional small-scale development within the countryside subject to compliance with relevant policies.”

“8.2.Applying the tiled balance involves a planning presumption in favour of granting planning permission when a local authority cannot demonstrate a five-year housing land supply, or when the most relevant local planning policies are out-of-date.”

Officer report

What members debated

Members debated housing need, the cluster policy, the site’s openness, dwelling scale, biodiversity, flooding and whether sufficient planning harm was shown.

“The Chair said it was a finely balanced case. He understood the concerns but the NPPF says you can only turn it down if there is significant harm. He was torn between local housing need but we have to consider the district wide housing need. Councillor Smithson agreed. It doesn’t meet our housing needs. However everywhere needs to take some housing not just the towns.”

“If it was a straight side and it doesn’t conform to the policy then the NPPF doesn’t allow you to build in the countryside. The Planning Manager said this wasn’t a finely balanced decision. The application meets the policy but he accepted members had concerns. He reminded them that they had to consider the tilted balance and was there demonstrable harm.”
