26/AP/2869 - Variation of a legal agreement Under consideration/assessment

Proposal

Variation to amend the Section 106 Agreement associated with planning permission 25/AP/3794 dated 28/03/2025 for Deed of Variation to amend the Section 106 Agreement associated with planning permission to replace all of the consented intermediate housing units with market units. Amendment to the Section 106 Agreement for planning consent as amended by the Deed of Variation reference 25/AP/3794 dated 25th June 2026 to the Section 106 Agreement. The proposed Deed of Variation seeks to update the existing Section 106 Agreement, planning conditions and associated drawings to reflect a series of proposed non-material amendments, including revisions to the mortgagee provisions applying to the Affordable Housing Units; a reduction in the number of parking spaces from 10 to 7, all of which would be designated as Blue Badge spaces; the proposed electric vehicle charging provision to be removed and replaced with a financial contribution; changes to the definition and plan relating to Affordable Workspace; the provision of on-site bicycles and associated infrastructure for a council-approved pedal-assist electric bicycle hire service; and minor amendments to the playspace, alongside confirmation of the continued availability of communal external amenity space. Flood zone 2, rivers and sea
Medium chance: between a 1 in 100 and 1 in 1,000 annual chance from rivers, or 1 in 200 to 1 in 1,000 from the sea. Any development here needs a flood risk assessment. Defences are not counted.
The Environment Agency flood map for planning. Homes in zone 3 must also pass the sequential test. Surface water flooding is a separate map.

2 Article 4 directions
Old Kent Road South District Town Centre · Site allocation NSP68: Sandgate Street and Verney Road. Named permitted development rights are withdrawn here.
An Article 4 direction withdraws particular permitted development rights, so work that would normally need no application needs one here. Not every council has published its directions.
Archaeological priority area: North Southwark and Roman Roads
An assessment or field evaluation may be asked for before ground works.
The council or Historic England considers archaeology likely here. A desk-based assessment, and sometimes trial trenching, can be asked for with the application.
Air quality management area: Southwark AQMA
The council has declared the area as failing an air quality objective.
Schemes that add traffic, parking or combustion plant are assessed against the area's action plan and may need an air quality assessment.

National infrastructure project 992 m away: Thames Tideway Tunnel
The site is 992 m from the project boundary. Waste water treatment, decided. The project page says whether consent was granted. Also within 2 km: London Strategic Heat Main Project (at pre-application, 1481 m).
Nationally significant infrastructure projects (power stations, electricity lines, pipelines, major roads and railways, harbours, airports and reservoirs) are consented by a Secretary of State under the Planning Act 2008, after an examination by the Planning Inspectorate, rather than by the council. The boundary is the one the Inspectorate consults on and can change as the scheme does. Projects are shown within 2 km of the site.
