26/00856/NMAApproved

What was proposed

The application sought changes to the approved site plan, including parking, storage and landscaping, plus revised wording for condition 10.

“A non-material amendment application for planning permission 23/00126/FULL to amend site plan, including parking arrangement, refuse/cycle storage and landscaping; amendment to condition 10 to reference drawing Z28-ZP-A1-XX-DR-A-010 S01-PROPOSED SITE PLAN REV P10, was received on the 25 th June 2026. These proposed changes are to be considered under s96A of the Town and Country Planning Act 1990.”

“Delivery of approved number of parking spaces through revised parking layout with one parking space moved from the eastern side of the site to the western side. • Increased landscaping along the eastern boundary of site and on the corner of Beech Road and Moorhayes Bungalows with more native meadow • Slight changes to designated cycle storage arrangements • Slight changes to designated bin storage arrangements…”

Officer report

The site and approved scheme

The site is level residential land within Tiverton’s settlement boundary, where eight affordable homes and nine parking spaces were approved.

“Application 23/00126/FULL was approved on 15 th April 2024 for the erection of 8 affordable dwellings following demolition of 4 existing dwellings with associated vehicular and pedestrian access, parking, landscaping and associated works at 2 - 8 Beech Road, Tiverton. Members may recall that this application was considered at Planning Committee on the 10 th April 2024 where it was resolved to approve subject to conditions.”

“The site is close to the junction of Beech Road with Moorhayes Bungalows, with Moorhayes Bungalows comprising of a row of terraced and semi-detached, single storey brick and tile roofed dwellings set back from the road with enclosed front gardens. The road serving the Moorhayes Bungalows also provides vehicular and pedestrian access to the neighbouring single storey Kingdom Hall of Jehovah’s Witnesses.”

Officer report

Earlier applications

The original housing permission was approved in April 2024, followed by an earlier non-material amendment granted in December 2024.

“23/00126/FULL - PERCON date 15th April 2024. Erection of 8 affordable dwellings following demolition of 4 existing dwellings with associated vehicular and pedestrian access, parking, landscaping and associated works. 24/01596/NMA - Non Material Amendment granted 5th December 2024”

“24/01596/NMA - PERMIT date 5th December 2024. Non-Material Amendment for 23/00126/FULL to allow amendments to site plan, including parking arrangements, refuse/cycle storage and landscaping…”

Officer report

Why the changes were needed

A fence and relocated telegraph pole prevented the approved parking layout, so one space would move and the former space would become native meadow.

“The non-material amendments proposed for 23/00126/FULL has been submitted to work around unforeseen constraints around providing the original parking layout as a fence has been installed that cuts across the site and a telegraph pole was relocated next to the new fence line. This prevented the original parking layout from being provided in accordance with the approved plans.”

“The development hereby approved shall not be occupied until the access and parking areas have been provided in accordance with the proposed site plan, drawing number Z28-ZP-A1-XX-DR-A-010 S01-PROPOSED SITE PLAN REV P10. Following their provision these facilities shall be maintained for the lifetime of the development.”
