Hot food takeaway at 18 Barlandfauld Street, Kilsyth

Summary of planning committee decision

Decided by North Lanarkshire Planning Committee on 9 Apr 2026.

25/01330/FULRefused

What was proposed

The application sought to change a shop into a hot food takeaway, alter the shopfront and install a roof-mounted extraction flue.

“Planning permission is sought for the change of use of an existing shop to hot food takeaway, including shop front alterations and installation of an ancillary roof mounted extraction flue.”

“The external shopfront alterations would see the existing shop frontage which is currently a blank frontage, to be altered to have larger areas of glazing installed on this elevation. An external roof mounted flue would be installed to provide odour extraction from the kitchen area and this would reach1 metre in height above the ridge line of the building to provide adequate clearance for odour extraction.”

This is a single storey, stand-alone commercial building which also has an integral garage; however, this garage is not owned by the site owner and is not part of the application.”

Officer report

Officers’ recommendation

Officers recommended refusal because the proposal would harm road safety and residential amenity and lacked sufficient extraction equipment information.

“It is considered that the proposed development is contrary to Policy PP3 (Purpose of Place) and Policies EDQ 1 & 3 and as such is considered unacceptable and likely to result in a detrimental impact on surrounding residential amenity and road safety sufficient to warrant refusal of the application in this instance.”

“Information was requested from the applicant in regard to technical details about the proposed extraction equipment to be installed, however this was not provided due to the applicant not currently having this information. As such it meant Protective Services were unable to confirm their position regarding both potential odour and noise from this proposal. Therefore the suitability of this element of the development cannot be assessed.”

Officer report

Consultation responses

Transportation objected over parking and road safety, while Protective Services sought ventilation details but Food Safety did not object.

“NLC Infrastructure and Transportation have reviewed information submitted to support the application. They have indicated that they object to the proposal and recommend refusal in regards to having no adequate off-street parking provision and also the subsequent on-street parking demand which would be likely to intensify existing parking pressures on Barlandfauld Street, which would increase congestion and reduce overall road safety.”

“NLC Protective Services do not object to the proposal subject to recommendations. However, Protective Services have requested further technical specification details about the ventilation and extraction equipment to be used at the site to be submitted for approval due to the nature of the development (cooking odour and fumes) and close proximity to residential dwellings.”

Officer report

Residents’ concerns

Six letters raised concerns about traffic, parking, disabled access, odour, extraction noise, disturbance, litter, anti-social behaviour and illuminated signage.

“During the public consultation period (neighbour notification and press advertisement) for this application a total of 6 representations comprising of 6 letters of individual representation were received.”
