What was proposed
The application sought retrospective permission for a replacement outbuilding in the rear garden, measuring 5 metres deep, 6.7 metres wide and up to 2.72 metres high.
“A retrospective planning application was first submitted to the Local Planning Authority in March 2025. The application reference for this application was 10/25/0248. After an assessment against the relevant adopted Development Plan Policies along with the NPPF the application was subsequently refused planning permission (see Section 5).”
“The proposal relates to a householder planning application for: ‘Replacement Outbuilding’.. The proposed garden room/outbuilding has a depth of 5m and measures 6.7m wide. At its highest point the garden room/outbuilding measures 2.72m and comprises of a sloping flat roof.”
Officer report
The site and its setting
The site is a two-storey detached house with gardens, a driveway and garage in an urban residential development where permitted development rights were removed.
“The application site relates to a two-storey detached dwellinghouse positioned to the southern side of Green Field, Darwen. The host dwelling comprises of garden areas to the front and rear, driveway and detached garage.”
“The property is part of the relatively new build development granted permission in 2012 (10/12/0933) for the Outline Planning Approval of up to 133 dwellings. Condition no. 19 on the planning approval removed permitted development rights for Classes A-F, Part 1 of the General Permitted Development Order (GPDO). The erection of an outbuilding falls under Class E and this is why planning permission is required.”
