Officer report
The site
The site is a largely pedestrianised market place in Mansfield’s historic town centre and conservation area, surrounded by historic properties and listed buildings.
“The application site relates to the Market Place in Mansfield, an oval shaped area of land located in the historic core (Market Place Conservation Area) of the town centre, largely pedestrianised, with the exception of access for service and delivery vehicles. Access is available from Church Street/Leeming Street (north), Stockwell Gate (northwest), Market Street (south).”
“The Market Place is surrounded by properties dating mainly from the C19 and early C20, many of which are considered of special architectural merit and/or historic interest some of which are listed or non-designated heritage assets, with the highest status building to this location is the Grade II* Listed Old Town Hall which has the same status as the Grade II* Listed Cavendish Monument and attached railings, which is part of this application as alterations are being proposed.”
Officer report
Earlier work and applications
The market place had earlier public realm improvements, previous consents affected the Bentinck Memorial, and a related listed building consent application was live.
“In terms of the Bentinck Memorial located in the centre of Market Place, listed building consent for repair and reinstatement of the lion statue was granted on 18 th May 2005 (2004/1175/WT) and consent for new and replacement lighting on the monument was granted on 9 th November 2005 (2005/0851/ST).”
“A live listed building consent application (2026/0305/LBW) has been submitted along with this full application for the current proposed works to the Bentick Memorial.”
Officer report
What officers recommended
Officers recommended permission with conditions because the scheme supported regeneration and town centre improvements, with public benefits outweighing identified heritage harm.
“In light of the above assessment, the proposed development is considered to be acceptable in principle as it accords with the regeneration and town centre improvement objectives of the Mansfield District Local Plan.”
“Whilst it is acknowledged that Historic England has identified some impacts to the heritage assets, officers considers that the proposal would result in less than substantial harm to the significance and setting of the designated heritage assets and can be further minimised through planning conditions. The public benefits of the scheme are considered to outweigh the heritage impacts in accordance with paragraph 215 of the National Planning Policy Framework.”
Officer report
What consultees said
Most consultees supported the proposal or raised no objection, while Historic England identified concerns about the memorial’s setting, views, drainage and detailed design.
“I have no objections to the proposal on arboricultural grounds. I do note that the surface treatment within the RPA's of trees has been described as being subject to additional design and would suggest that the design is subject to a condition requiring approval prior to implantation. I would also prefer to see that the design of the new tree put installations be subject to similar scrutiny to avoid long term conflicts of interest with surfacing.”
“Supportive of the principle of improving the public realm of Mansfield marketplace but raise some minor concerns: • Loss of some of the openness around the memorial due to the garden/play area 02 being so close to its immediate setting.”
Officer report
What the committee considered
The committee was told that Severn Trent had raised no objection subject to implementing the approved drainage scheme before first use, requiring an additional condition.
“The committee considered a Regulation 3 application for public realm improvement works to Mansfield Market Place, including new landscaping, street furniture and lighting. The planning officer updated the committee that comments had been received from Severn Trent on 17 July, confirming no objection subject to the proposed drainage scheme being implemented in accordance with the approved details before the development was first brought into use.”
