“The application site forms part of a Grade II listed public park, which is allocated Open Space and is located within the settlement of Blackburn. All of the park is within the ownership of the Council. Dwellings and open land surround the park to all 4 sides. The area of parkland earmarked for the container is currently covered in hardstanding/exposed earth.”

P215 of the NPPF allows LPAs to consider the less than substantial harm against the public benefits generated by a proposal, including where appropriate securing an optimum viable use.”

“If the LPA consider an appropriate balance can be achieved, then the proposal would meet the requirements of Chapter 16 of the NPPF. Should the LPA be minded to approve the application, I would recommend consideration of a condition that secures its removal when no longer required.”
