Mixed-tenure affordable housing at Land At Cwmrhydyceirw Quarry, Morriston, Swansea

Summary of planning committee decision

Decided by Swansea Planning Committee on 31 Mar 2026.

2026/0327/106Approved

The site and development

The site has outline permission for about 300 homes, with later reserved matters approvals and construction continuing.

“The development was granted outline Planning Permission on appeal for circa. 300 dwellings on 11th January 2018. Several subsequent reserved matters applications have been granted at the site and construction is ongoing.”

Officer report

The affordable housing history

The original obligation required five per cent affordable housing as low-cost home ownership, and 15 such homes were provided in phase two.

“The Section 106 Planning Obligation accompanying the outline application required the provision of 5% affordable housing to be delivered as Low Cost…”

“Home Ownership (LCHO) dwellings. This requirement has been provided as 15 dwellings within phase 2.”

Officer report

Why officers recommended approval

Officers considered the affordable housing purpose would remain useful and be equally served because social rent meets the highest housing need and remains affordable in perpetuity.

“With regard to the first question, it is considered that the original obligation still serves a useful planning purpose in that the required affordable housing is still required. This would not change. The requirement for Affordable Housing is clear in both local and national planning policy. Technical Advice Note 2: Affordable Housing (2006) provides practical guidance on the role of the planning system in delivering such housing.”

“With regard to the second question, as social rent is the highest housing need and we know these properties will be affordable in perpetuity then clearly the planning purpose would be equally served by the proposed modification.”

Officer report

Council officers’ views

The legal officer required a deed of variation, while the housing officer agreed to changing the tenure to allow social rented affordable housing.

“Council’s Legal Officer - My only comment on this is that it will need a Deed of Variation and will need to be reported to Planning Committee for decision.”

“Council’s Housing Officer – I can confirm agreement to modify the Section 106 Agreement dated 7th November 2017 attached to planning permission 2014/0977/FUL granted on appeal 11th January 2018 to change the affordable tenure. The proposed modification will allow the Registered Social Landlord to buy back properties previously sold under staircasing leases and for those properties to thereafter be made available as social rented affordable tenure.”

Officer report

Committee consideration

The application was presented to the committee, and the request was supported by council officers.

“The Lead Lawyer on behalf of the the Head of Planning and City Regeneration presented a report which sought authorisation to modify the Section 106 Agreement relating to Planning Permission 2026/0327/106 for the development outlined above.”

“The background details of the application and relevant planning history were all outlined in the report. The request was supported by Swansea Council Officers.”
