TCA/000790/26 - Trees in Conservation Area Application Valid

Proposal

The client has a large magnolia situated at the front of the property that is growing into phone wires and into the property, it is also encroaching onto the street. I propose to reduce the height of the tree to below the phone wires, approximately 1-2m to previous reduction points (to the top of the upstairs windows) and spread by 1-2m to keep the tree contained and to prevent future damage from passing vehicles. Works will be carried out to BS3998. Data via plota.co.uk

Grade II listed: 2 Rectory Lane
List entry 15099 · 6 m away · 49 more listed buildings within 150 m (1 Grade I, 1 Grade II*, 47 Grade II)
Listed building consent is needed for work that affects the special interest of a listed building, inside or out, on top of planning permission. Setting can be a consideration for buildings nearby; there is no fixed radius.

Hawarden conservation area
Demolition needs planning permission and permitted development is restricted.
The council must give weight to preserving or enhancing the area's character and appearance. Not every council has published its boundaries as open data.
Radon affected area, class 6
An estimated 30% or more of homes reach the radon action level. Indicative for the 1 km square, which takes the highest class found in it; a radon test gives the answer for a building.
From the British Geological Survey and UK Health Security Agency indicative atlas. Under building regulations, as the BRE guide BR 211 (2023) sets out, new buildings and extensions need basic radon protection from class 3 in England and Wales and from class 2 in Scotland, and full protection from class 5. The class at the site itself, from the detailed BGS map, decides which.

Registered park or garden 91 m away: Hawarden Castle
Its setting is a consideration for work nearby.
Registered parks and gardens, battlefields, world heritage sites and protected wrecks are designated heritage assets: harm needs clear and convincing justification.
National infrastructure project 1027 m away: HyNet Carbon Dioxide Pipeline
The site is 1027 m from the project boundary. Pipeline, decided. The project page says whether consent was granted. Also within 2 km: Hynet North West Hydrogen Pipeline (at pre-application, 1027 m).
Nationally significant infrastructure projects (power stations, electricity lines, pipelines, major roads and railways, harbours, airports and reservoirs) are consented by a Secretary of State under the Planning Act 2008, after an examination by the Planning Inspectorate, rather than by the council. The boundary is the one the Inspectorate consults on and can change as the scheme does. Projects are shown within 2 km of the site.
