Approved plan changes at Land To The West Of Red Cat Lane, Burscough
Summary of planning committee decision
Decided by West Lancashire Planning Committee on 30 Jul 2026.
What was proposed
The application seeks to vary condition 2 by correcting and updating the approved plans for a development already allowed on appeal.
“The application seeks to vary condition 2 imposed by the Inspector in the determination of planning permission ref: 2022/0958/FUL (Appeal decision ref: APP/P2365/W/25/3374202). The relevant condition states:”
“The development hereby permitted shall be carried out in accordance with the following approved plans: REDCATLANE/LOC/011, REDCATLANE/SK/04 Rev V; REDCATLANE/PL/50; REDCATLANE/CHARGE/01; REDCATLANE/SURF/01; REDCATLANE/STREET/01 Rev F; LANCS-HOLLY-P-01; SDL 1800WF; SDL 1200PR; SF10; Planning House Type Booklet 2022; 2246-FOI; and Pumping Station Kiosk Sections and Layout Plan.”
Officer report
The site and surroundings
The 1.3-hectare greenfield site is beside homes, Red Cat Lane, a public footpath and open farmland, and is safeguarded land.
“The site is approximately 1.3 hectares in size, is rectangular in shape and is bound to the north by a public footpath, beyond which is an agricultural field and a few sporadic residential properties. To the east of the site is Red Cat Lane with a number of detached and semi-detached properties along its length. To the south of the site the boundary abuts four detached dwellings and to the west are residential properties on Moss Nook.”
“The site is greenfield and was last used for arable agriculture. It is bound by hedgerows along the northern and eastern sides with some hedges along the western boundary, The site's topography gradually slopes from west to east and there is a field across into the site from Red Cat Lane. The existing built-up area of Burscough lies to the south, east and west of the site, with open, arable farmland to the north.”
Officer report
Earlier decisions
An earlier residential application was refused by the committee but allowed on appeal; a 2018 application for 38 homes was withdrawn.
“2022/0958/FUL - Residential Development - Refused (Allowed at appeal)”
“2018/0464/FUL – Land to the west of Red Cat Lane – Residential development (38 units) - Withdrawn…”
Officer report
Consultees’ views
Highways considered the changes would have negligible highway effects, while environmental protection and the town council opposed longer construction hours.
“It is considered that the proposed extension of construction hours would result in an increased risk of amenity loss to residents through noise and dust impacts associated with additional construction and vehicle movements. No sufficient assessment has been undertaken to evidence that these additional construction hours would result in no significant impact on amenity.”
“Further comments provided in response to applicant/agent email. These can be summarised as: The proposed hours and statement given in the file note has been fully considered, and Environmental Protection is not satisfied that sufficient supporting evidence has been provided to agree to these extended construction hours.”
Officer report
Residents’ concerns
Residents objected to changed hours, citing possible harm from noise, dust, fumes, lighting, traffic, parking and safety risks.
“Burscough Town Council noted that changes to the conditions to access times would affect loss of amenity to the residents, this would cause considerable disruption with noise and accessibility of large vehicles attending the site due to the limited access to the development site.”
“Objection to the proposed variation of Condition 16 Consider there is no need/justification for the proposed changes. The hours imposed by the Inspector are considered to be long enough The changes would cause harm to the amenity of neighbouring properties. Given the developer it is expected the development would be on-going for a long time. The resultant loss of amenity for all that time would not be acceptable.”
Officer report
The committee’s decision
The committee resolved to grant the application subject to a deed of variation to the original Section 106 agreement and recommended conditions.
“The Assistant Director of Planning and Regulatory Services submitted a report on Planning Application 2026/0229/FUL, relating to Land West of Red Cat Lane.”
“RESOLVED: That planning application 2026/0229/FUL be granted subject to a deed of variation to the original Section 106 Agreement and conditions as set out by the Officer recommendation.”
