“This S73 application proposes varying condition 15 of planning permission 09/00727/FUL which itself is a section 73 application to extend the delivery hours on Sundays only to between 0700-2100 hours. Currently deliveries on a Sunday are only permitted between the hours of 0900 and 1700.”

“Members noted that the original submitted assessment placed the rating noise level at or very close to the background level, meaning that any small variation (as little as 1dB) would result in non compliance with the Council’s noise guidance.”

“Members noted that the updated report showed the rating level as at least 5dB below background noise however concern was raised that the assessment did not apply appropriate characteristic corrections in accordance with BS4142 and industry guidance.”

“Overall, the Committee concluded that it had not been satisfactorily demonstrated that the proposal would avoid adverse impact on nearby residential amenity, particularly in sensitive early morning periods.”
