NP26/0905 - Conservation Area Tree Work Decided

Proposal

I am applying to fell a sycamore tree. The tree is close to the wall between my garden and the car park belonging to the public house next door, the Anglers Rest. The roots of the tree and its canopy spread over both my garden and the pub car park, which includes parking, a shelter for drinkers and numerous picnic tables for the use of patrons. There is also a telegraph pole used for internet and phone wires at the end of the wall. The wall between my garden and car park by the tree has already cracked in several places. I am concerned that the tree could cause further damage. In addition, if branches break off during bad weather (which has happened before), it's a risk to the public using the pub and their cars, as well as to us in the garden. The telegraph pole is vulnerable if the tree is more substantially damaged. I am attaching to this submission a document which includes a sketch plan to indicate the position of the tree and some photos in support of the points made above. ... Data via plota.co.uk

Site constraints 13

Nutrient neutrality catchment: Peak District Dales SAC
New homes and overnight accommodation must show nutrient neutrality before approval.
Natural England advice: extra wastewater in these catchments harms protected habitats, so schemes must offset their nutrient load, usually through credits.
Peak District National Park
The park authority decides applications here. Great weight to conserving the landscape; major development restricted.
Landscape, scenic beauty and wildlife carry great weight, and major development is only allowed in exceptional circumstances.
Public footpath about 8 m away
Matters where it crosses or adjoins the site: obstructing a path without a diversion order is an offence, and work cannot start until the order is confirmed.
Compiled from highway authority data, not the legal definitive map. A few authorities have not published, so no path shown is not proof there is none.
Millers Dale conservation area
Also Millers Dale. Demolition needs planning permission and permitted development is restricted.
The council must give weight to preserving or enhancing the area's character and appearance. Not every council has published its boundaries as open data.
Special area of conservation about 17 m away: Peak District Dales
Work nearby can need a habitats assessment.
Harm to a protected site is only accepted where there is no alternative and an overriding public interest.
Agricultural land, grade 5
Very poor quality farmland, not best and most versatile. Source: the Predictive Agricultural Land Classification Map (Defra and Natural England, 2025; the Welsh Government's Predictive ALC Map 2 in Wales), a model rather than a site survey. Natural England's Provisional ALC map (1:250,000, 1970s) agrees.
Where development of farmland is needed, policy prefers poorer land over the best and most versatile (grades 1, 2 and 3a). Three sources: Natural England's post-1988 field surveys, which are definitive where they exist; the Defra predictive map for England (2025) and the Welsh Government predictive map, modelled from the soil map with 3a and 3b split; and the 1970s provisional map, which planners and other services still show, coarser and with grade 3 undivided. Where the provisional and predicted grades disagree, treat the predicted grade as the current estimate and expect an application to carry its own survey.
SSSI about 17 m away: Monk's Dale SSSI
Natural England may need consulting, depending on what is proposed.
Sites of special scientific interest are the best wildlife and geological sites in the country. Development likely to harm one is rarely permitted.
5 listed buildings within 150 m of the postcode pin
Nearest: Church of St Anne, Grade II, about 18 m from the postcode pin · 1 Grade II*, 4 Grade II
The site itself is not listed. Listed building consent is needed for work that affects the special interest of a listed building, inside or out, on top of planning permission. Setting can be a consideration for buildings nearby; there is no fixed radius.

Habitat network: Other Priority Habitats - NEZ
Where habitat is joined up enough to work as a network. Context, not a constraint on its own.
Radon affected area, class 6
An estimated 30% or more of homes reach the radon action level. Indicative for the 1 km square, which takes the highest class found in it; a radon test gives the answer for a building.
From the British Geological Survey and UK Health Security Agency indicative atlas. Under building regulations, as the BRE guide BR 211 (2023) sets out, new buildings and extensions need basic radon protection from class 3 in England and Wales and from class 2 in Scotland, and full protection from class 5. The class at the site itself, from the detailed BGS map, decides which.

Nature recovery project: Wye Valley; Priority habitat about 12 m away: Deciduous woodland; Open access land about 6 m away: Access Land - Combined Open Country, Registered Common Land and Section 16 Dedicated Land. MoD Byelaw, Section 28 Exclusions, Racecourses and Aerodromes and ECP Margin have been removed..
Not affected
Outside flood zones 2 and 3 · Not green belt · No scheduled monument at the site

Checked on 6 October 2026. The pin for this application is the centre of its postcode rather than the building, so distances to nearby designations are measured from the postcode and can be out by the width of the postcode area. Historic England, the Environment Agency, Natural England, the British Geological Survey and UK Health Security Agency (radon, contains BGS materials © UKRI) and council datasets, Open Government Licence. A boundary can run through a site and the council holds the definitive record: confirm with the council before relying on this.
