Two semi-detached homes at Land East Of Thurvaston Road, Marston Montgomery

Summary of planning committee decision

Decided by Derbyshire Dales Planning Committee on 13 Jan 2026.

25/00621/FULApproved

What was proposed

The application proposed two five-bedroom semi-detached homes with parking, gardens, red brick construction and boundary trees.

“The application site comprises an area of land (approx. 0.11ha) located to the northern part of Marston Montgomery. The site is accessed off Thurvaston Road. The site was previously a woodland at the edge of the settlement. However, it was cleared, and the front part of the site was used for parking during the construction of the development opposite (Marston House Farm), with a retrospective permission being approved for this use (ref.”

“Planning permission is sought for the erection of a pair of semi-detached 5-bed dwellings on the site. The dwellings will share an open parking area to the front, with 3 car parking spaces for each dwelling. To the rear each dwelling will lead out into a patio area with steps up to a raised lawn area, providing approx. 240sq.m of rear amenity space. The dwellings will be of red brick construction. The site will be bounded by trees to its north and south boundaries.”

Officer report

The site and surroundings

The site was scrubland with a container, surrounded by homes on three sides and open countryside to the north.

“The site is surrounded by residential dwellings to the south, east and west with open countryside to its north.”

Officer report

What officers recommended

Officers recommended approval, considering the scheme acceptable in principle and compatible with local character, amenity, highway safety, trees and biodiversity requirements.

“The dwellings will be accessed via Thurvaston Road which is a 30mph road. The proposals have been assessed by the Local Highway Authority, with additional information being provided throughout the consideration process to address their comments, in respect to the level of parking provision per dwelling visibility splay requirements and footway arrangements. Drawing No. 1781-101 Rev.”

“There is a linear group of trees present along both the north and south boundaries of the development site, which appear to be historic field boundaries and former hedgerows. These trees contribute to the amenity, character and appearance of the local landscape and provide natural screening opportunities for the site.”

Officer report

What consultees said

Highways, ecology, trees, environmental health, archaeology and the Environment Agency raised no objection or supported approval subject to conditions.

“The highway authority has considered the amended details submitted in support of the above planning application and would have no objection subject to recommended planning conditions and informatives being attached to the decision notice if planning permission is granted.”

“11.08.2025 comments: Noted the proximity of development to the trees. Advised that if consent for the existing layout is given, that all guidance and recommendations provided by the submitted arboriculture report should be required to be followed to minimise harm to retained trees and to provide and maintain tree planting on the site. DDDC Environmental Health No objections. 24.09.2025 No objections to the application in principle.”

Officer report

Objections and concerns

The parish council and five representations raised concerns about housing size, drainage, privacy, traffic, parking, overdevelopment and the land’s condition.

“Historically this site allowed water drainage from the land above, which currently is diverted, and now causes road flooding after wet weather. The council is therefore concerned about drainage intentions around and from the site (stormwater run-off and also sewerage).”

“− Concerns with the changing use of the land, which was previously an orchard, which was impacted by its temporary change of use in association with the development adjacent and never returned to its previous use and is now being offered for residential development. − Water run off from the site onto other properties. − Concerns about type of boundaries to the development and how this would impact privacy and daylight to other properties.”

Officer report

Who spoke

The development management team leader presented the application, and the agent spoke in support.

Members’ discussion

Members discussed drainage, permeable paving, wheel washing, tree planting, biodiversity net gain and the practicalities of parking.

“Surface water run-off and whether the new drainage proposals were sufficient to accommodate changes to existing drainage and increased paved areas to the frontage of the proposed development.”

“Members emphasised that any wheel washing conditions contained in the approval notice should be strictly enforced.”
