DC/100448 - Tree Works In A Conservation Area Registered

Proposal

Location and Land Ownership. The trees and shrubs are located on land belonging to Dermot, to the rear of the property, along the boundary with Scotts garden. The works are to be carried out on Dermot?s land, adjacent to Scotts existing garden fence. Address of the trees is Fern Cliff 18 Mauldeth Road, Heaton Mersey, Stockport, SK4 3NG. Description of Works A row of self-seeded trees and shrubs is growing along the bottom boundary of Scott?s garden, immediately adjacent to the existing fence on Fern Cliffs land. The vegetation is causing damage to the fence, dropping leaf litter and bird fouling into the garden, and restricting natural light. The proposed works are to remove the identified trees and shrubs to ground level, allowing Scott to install a replacement fence line for improved security, so basically clearing across the width of his back fence. Trees and Shrubs Identified, self seeded messy mixed group. T1, T2 and T3 Sycamore TG1. Holly group T4. Beech T5 and T6. Ash Multiple shrubs and brambles mixed in. HAR/CA21, TPO 9N. Site constraints 6

Mauldeth Road conservation area
Demolition needs planning permission and permitted development is restricted.
The council must give weight to preserving or enhancing the area's character and appearance. Not every council has published its boundaries as open data.

Article 4 direction
Mauldeth Road. Named permitted development rights are withdrawn here.
An Article 4 direction withdraws particular permitted development rights, so work that would normally need no application needs one here. Not every council has published its directions.
Radon affected area, class 5
An estimated 10 to 30% of homes reach the radon action level. Indicative for the 1 km square, which takes the highest class found in it; a radon test gives the answer for a building.
From the British Geological Survey and UK Health Security Agency indicative atlas. Under building regulations, as the BRE guide BR 211 (2023) sets out, new buildings and extensions need basic radon protection from class 3 in England and Wales and from class 2 in Scotland, and full protection from class 5. The class at the site itself, from the detailed BGS map, decides which.
UKHSA radon ↗
Protected tree 11 m away: TPO-9N, order TPO-9N
Named in a tree preservation order: work to it, its roots included, needs the council's consent first.
Root protection areas reach up to 15 m from a large tree, so an extension or new foundations this close usually needs a tree survey. Only some councils publish their single trees, and a position can be approximate: the order at the council is the definitive record, and no tree shown is not proof there is none.

A boundary can run through a site and the council holds the definitive record: confirm with the council before relying on this.
