Officer report

The site

The site is part of a grazing field beside Milton Lane, accessed over a private bridge, in a rural landscape and flood zones 2 and 3.

“SITE DESCRIPTION 4.1 The site comprises part of a grazing field positioned on the east side of Milton Lane, accessed via an existing private bridge over Peasy Beck. The land is used by the applicant for existing equestrian purposes. The site is within a rural agricultural landscape with open fields, hedgerows and watercourses. Officer report

Officers recommended approval

Officers considered the proposal acceptable in principle, with suitable design and scale, no unacceptable effects on neighbours or highways, and conditions to mitigate potential harm.

“The scale and design of the proposed stable block is consistent with the site location context, being of a height and material in keeping with existing nearby agricultural buildings, and as such the development is considered acceptable in this location. There will be no external lighting, and this is considered to protect the landscape and countryside dark skies.”

“In assessing the material issues, on balance the proposed development is considered acceptable in principle in this location. The scale and design of the proposal is acceptable in relation to the location, and the proposal would not adversely affect visual and neighbour amenities of surrounding properties.”

Officer report

Consultation responses

The parish council objected because of the stable’s proximity to homes; the access officer had no objection, the Canal and River Trust had no comment, and Public Protection sought manure controls.

“Canal and River Trust 6.3.1 Based on the information available our response (as required by the Town & Country Planning (Development Management Procedure) (England) Order 2015 (as amended)) is that the Trust has no comment to make on the proposal. Public Protection 6.4.1 Prior to the commencement of the development, details of where and how manure is to be stored and ultimately disposed of shall be submitted to and approved in writing by the Local Planning Authority.”

Officer report

Who spoke

The agent spoke in support of the application.

Members’ discussion

Members queried why the conditions did not expressly ban burning manure or waste, despite the restriction appearing in the report.

“Members’ attention was drawn to the site plan, block plan and proposed elevations and floor plans as well as photographs of the surrounding area. Members were informed of the flood mitigation scheme and evacuation plans and that conditions would prevent the stable from being used for commercial purposes.”

“Members queried the lack of a condition to prevent the burning of manure or waste material on the site, they referenced its inclusion within the report but felt that it should be included in the conditions attached to any potential approval.”
