Extended tearoom opening hours at Eden Tearoom And Galleries, Course Lane, Newburgh, Wigan

Summary of planning committee decision

Decided by West Lancashire Planning Committee on 12 Feb 2026.

2025/0990/FULApproved

What was proposed

The application sought permanent extended opening hours for the tearoom and galleries, including midnight closing on Fridays and Saturdays.

“Three separate temporary permissions have been granted (the most recent on 24/01/2023, for a period of 3 years) for the following extended opening hours: Monday to Thursday 0800 to 2200 hours; Friday and Saturday 0800 to 0000 hours; Sunday 0800 to 2100 hours. The latest temporary permission expires on 25/01/2026.”

“This application seeks permanent planning permission for the extended opening hours.”

Officer report

The site

The site is on the northern side of Course Lane, on Newburgh’s western outskirts, with three access points and Green Belt designation.

“The application site is Eden Tearoom and Galleries, and its associated grounds, on the northern side of Course Lane, on the western outskirts of Newburgh. Access to the site is via Course Lane. There are 3 access points from Course Lane, albeit not all are in use.”

“The site is in the Green Belt. The site is also partly within a Minerals Safeguarding Area.”

Officer report

What officers recommended

Officers recommended permanent approval because a fourth temporary permission was inappropriate and the effects were acceptable with controls tied to the current operator.

“It would not be appropriate to grant permission on a temporary basis for a fourth time, not least because this creates further uncertainty for the applicant. It is recognised that concerns have been raised about the fact very few late-night events have been held during the temporary period and so the impact cannot be properly judged; however, 5 years should be sufficient time for the impact to be monitored and the Council cannot compel the applicant to hold more…”

“There is concern that allowing the extended opening hours on a permanent basis may lead to an intensification of the use (e.g. late-night events on a more regular basis). Taking into account the last 5 years, this does not seem likely, but it is recognised that it is possible, particularly if there was a change in operator. On this basis, it is recommended that any permanent permission for extended opening hours be tied to the current business operator.”

Officer report

Noise and residential amenity

Noise management measures, operating restrictions and conditions were considered sufficient to control impacts on nearby homes.

“There is concern about the later opening hours on Friday and Saturday and the impacts associated with this (e.g. noise from people leaving and potentially congregating outside; car doors slamming; car engines; taxis etc.). There is a Noise Management Plan (NMP) associated with the premises (as a requirement of the premises license). The NMP incudes various measures to mitigate the impact on local properties and minimise the risk of complaints.”

“It is noted that when a late-night event with music was held at the venue, music was audible at neighbouring properties. The NMP sets noise limits for amplified music to ensure that amplified music is not distinguishable at the boundary of neighbouring properties.”

Officer report

Conditions and decision

Permission was granted with extended hours for the current operator, noise controls, delivery limits and restrictions on outdoor seating use.

“The following operating hours shall apply solely for the benefit of the current operator, Eden Tearooms Ltd: The premises shall only be open to customers between the hours of 0800 to 2100 hours on Sundays / Bank Holidays; 0800 to 2200 hours Monday to Thursday; 0800 to 0000 Fridays and Saturdays.”

“The plan shall include but not be limited to the measures required to control and minimize noise associated with the operation of the premises to ensure that the noise output from the premises is controlled so as not to cause disturbance and shall also contain appropriate contact details in the event of any complaints. Within one month of the date of that approval, the approved Operational Noise Management Plan shall be implemented at all times thereafter.”

Officer report

Committee decision

The committee granted planning permission subject to conditions.

“The Assistant Director of Planning & Regulatory Services submitted a report on planning application 2025/0990/FUL, relating to Eden Tearoom and Galleries, Course Lane, Newburgh, Wigan, Lancashire, WN8 7UB.”

“RESOLVED: That planning permission be granted, subject to conditions, as set out at paragraph 12.1 of the report.”
