Officer report
What officers recommended
Officers recommended approval because the amendments were minor, acceptable under planning policies and did not materially change the approved development.
“Taking the above into deliberation, the proposal for additional planting and screening is considered acceptable. Whilst it is acknowledged that the constructed pathways have deviated from that of the approved plans, the local planning authority have considered the changes in line with local planning policy and planning guidance. No objections have been raised during consultation and as such the proposed amendments are considered acceptable.”
“Conclusion In this regard, the Section 73 Application, when considered within the context of the whole of the site, is not considered to materially alter the design, layout, appearance, or landscaping of the approved development and it is considered to constitute a minor material amendment.”

Concerns raised
Concerns focused on the proposals’ proximity to homes, deviations from approved plans, insufficient landscaping, fencing and plot 157’s policy compliance.
“The Chairperson introduced Councillor Helen Greener who wished to speak in objection to the application. Councillor Greener wished to raise concerns over the proximity of the proposals to the existing properties and that the paths deviated from the plans.”
“Objections had been received and even with the extra landscaping there were still concerns, therefore Councillor Greener urger extra landscaping be undertaken or the plans be amended to reflect the original proposal.”
Minutes
Member discussion
Members discussed additional landscaping, a permanent fence and a condition setting a timeframe for installing the fence and planting.
“Councillor Greener wished to clarify that it should be 2 and 3 Cavalier Way and not “1 and 3” and suggested that the temporary fence proposed would not help and a 8 foot permanent fence would be required.”
“Councillor Haswell wished to thank the Committee and the developer for agreeing to previous deferrals and enquired if an additional condition could be added to enforce Condition 7 and the tree planting to suggest a fixed time frame for the implementation of the fence and that this be delegated to Officers to write the wording of such a suitable condition. The Planning Officer advised that they would be happy to include such a condition.”
