Summary of planning committee decision

Decided by Sunderland Planning and Highways Committee on 30 Mar 2026.

25/02142/VARApproved

What was proposed

The applicant sought to raise the nursery’s child capacity from 50 to 75 and remove two existing conditions.

“INTRODUCTION This application has been made under s.73 of the Town and Country Planning Act (1990) and it seeks permission for a variation of condition 6 (occupancy) attached to 21/02435/FUL (Change of use of existing residential care home (Use Class C2) to non-residential institution as a children's day nursery.)”

“The Applicant proposes to extend the current limit of child capacity under condition 6 from 50 to 75. They have also, as part of this proposal, requested the removal of conditions 1 (3 years) and 4 (pedestrian barriers), on the basis that the conditions are no longer relevant.”

Officer report

The site and surroundings

The nursery occupies Rowlandson House within a conservation area, near a signal-controlled junction and double yellow lines.

“The host property is located within The Cedars Conservation Area and sited at the north west end of the Edwardian period Rowlandson Terrace. The host unit turns the corner of Ryhope Road and Villette Road and is served by a lane to the rear where a set of double gates open into a yard area covering 162 square metres.”

“The immediate highway network is characterised by the four-arm signal-controlled junction with pedestrian phases across all arms, double yellow lines also surround the site to prevent illegal parking on or in the vicinity of the junction.”

Officer report

What officers recommended

Officers recommended approval because the increase would not create unacceptable effects on local amenity or highway safety.

“The Council's Highways officer has given careful consideration to the proposal, taking into account the supporting material provided by the applicant's Transport Consultant and the impact the operation of the nursery currently has on highway safety and the operation of the local road network.”

“On this basis, it is considered that the variation of condition 6 (occupancy) attached to 21/02435/FUL will not give rise to any unacceptable adverse impacts on local amenity or highway safety, in accordance with the requirements of policies BH1, BH7, BH8, ST2 and ST3 of the CDSP.”
