Officer report
Officers’ recommendation
Officers recommended approval because the replacement would occupy the existing footprint, reduce floor area, support the rural economy and preserve Green Belt openness.
“This is subject to: a) the existing building(s) being lawful and permanent b) the design and volume of the proposed replacement buildings would not be materially larger than the ‘original’ building and would not materially harm the openness of the green belt through excessive scale, bulk or visual intrusion; and c) the replacement building would be within the same use as the building to be demolished 40 The existing stable building on site is lawful and permanent in nature.”
Officer report
Consultation responses
The parish council objected over height, site conditions, trees, commercial status and possible residential conversion, while environmental health raised no objection.
“Consultations 23 Hever Parish Council – objects for the following reasons: • The building proposed is materially higher than the existing – 0.723m higher (18.9% increase); • Two mobiles remain on site; • Staff lodge should be discounted from floor area; • Tree assessment should be submitted. • Not a ‘bone fida’ commercial enterprise; • Building will be converted into a dwelling in the future.”
“24 KCC Ecology – No comment received 25 SDC Environmental Health – Existing drainage on site is adequate - No objection raised Representations 26 Two third party objections received objecting on the following grounds: • Is there a need for the building?; • The staff lodge should not be considered as part of the application…”

Members’ discussion
Members noted the barn’s greater ridge height but smaller footprint and set-back position, and supported an informative about removing the staff lodge.
“Members asked questions of clarification of the speakers and officers. They were advised that the proposed barn was slightly less tall than the isolation stables, and was set further back within the site. No work would be conducted near the tree that required protection until a suitable plan was in place. The ridge height of the proposed barn was 0.7m taller than the existing stables, but overall had a smaller footprint.”
“Members discussed the application. They supported the inclusion of the informative, as the staff lodge was required to be removed within 6 months of the Inspectorate’s decision, but this had not yet been done. They noted that although the proposed barn was taller than the existing stables, it was set back from the road.”
Minutes

The decision
Planning permission was granted subject to conditions controlling plans, materials, use, lighting, trees, landscaping and biodiversity.
“5) No further work above slab level of the development hereby permitted and any further demolition to the existing stables shall take place, until a scheme showing the exact position of protective fencing to enclose all retained trees as shown on the submitted plans, beyond the outer edge of the overhang of their branches in accordance with British Standard 5837:2012: Trees in Relation to Construction (or later revision), has been submitted to and approved in writing by the…”
“The approved landscaping details shall be carried out in the first planting and seeding season following occupation of the buildings or the completion of the development, (whichever is the earlier) or in accordance with a programme agreed with the Local Planning Authority. All hard and soft landscape works shall be carried out in accordance with the appropriate British Standards or other recognised Codes of Good Practice, to the satisfaction of the Local Planning Authority.”
Minutes
Staff lodge requirement
The applicant was advised to remove the existing staff lodge immediately or as soon as practicable, or face possible enforcement action.
“The applicant is advised that the existing staff lodge on the site must be removed immediately, or within the shortest practicable timescale. Failure to comply will leave the Local Planning Authority with no option but to consider formal enforcement action, as the retention of the staff lodge constitutes an ongoing breach of Condition 4 of planning appeal reference APP/G2245/C/24/3352309.”
