What was proposed

A waste treatment facility would include an 84-metre building, welfare facilities, a weighbridge, fencing, parking and areas for waste and soil treatment.

“The application proposes a waste treatment facility (for managing secondary materials) including a treatment building which will be 84m long and 29m wide (2436m 2 ). Externally existing concrete surface will be retained where possible. All waste operations (sorting, separation, shredding, bailing, bulking) will take place inside the building. The building will house both fixed and mobile plant.”

“The area around the waste treatment building and the associated external area will be enclosed by mesh security fencing 2m high and green in colour. A welfare cabin will also be provided for employees with parking.”

Officer report

The site

The 2.35-hectare site is a former opencast coal site with existing access, concrete areas, settlement ponds, spoil heaps and recovering vegetation.

“The proposed development site measures 2.35 ha. and lies south of the A71 with the settlement of Stane 1.2 km to the north, on the site of the former Damside opencast coal site. The site access continues unchanged from that utilised for the former open cast development. The surrounds comprise a mixture of agricultural land, commercial conifer plantation and areas of land immediately around the site stripped of vegetation and in some areas soil with no vegetation.”

Officer report

Earlier site history

The site was used for opencast coal extraction, later faced enforcement action over restoration, and relevant conditions were confirmed as discharged in 2021.

“Formal enforcement action 13/00194/COMP breach of Planning condition for Permission 00/00811/MIN notice served 29 th October 2013 breach of condition 3. A revised restoration scheme was received and approved. The planning record indicates that relevant conditions were confirmed as discharged 13 th January 2021.”

Officer report

Officers’ recommendation

Officers recommended approval subject to conditions because the proposal was acceptable overall and could reuse the former mining site without significant harm nearby.

“The application is on balance considered acceptable in terms of the Development plan. The proposal while not supported in principle as a countryside use none the less when measured against the supporting policies of the Development Plan is accepted not least given the sites mining legacy providing existing secluded infrastructure to enable contribution to zero waste targets without significant adverse impact to the surrounding area.”

Officer report

Consultation responses

The Coal Authority withdrew its objection, roads accepted revised access details, and conditions addressed ecology, contamination and biodiversity matters.

“Coal Mining Remediation Authority initially objected to the application, however, following submission of a revised Coal Mining Risk Assessment requiring further consultation, the Coal Authority withdrew its objection recommending an informative covering ground investigation works.”

“NLC Roads recommended that the application be deferred pending further detail clarifying access detail on access visibility, vehicle types. Revised detail was submitted and accepted.”
