Officer report
What consultees said
DFI Roads said the fence blocked visibility splays for the applicant and neighbouring dwellings and was unsatisfactory for road safety.
“Figure 2 – Image of the fence at the junction with the access lane to neighbouring dwelling. On the 16 th September 2025 DFI Roads responded stating the applicant ’s visibility splays are blocked by the fence to be retained. On a response from DFI Roads on the 4 th July 2025 it is stated that the fence also blocks the visibility splays for the occupants of no.57 and no. 59 in the adjacent lane which has been shown in figure 2 above. DFI”
“Roads do state in the 4 th July response that as the visibility splays are blocked this is not satisfactory in terms of road safety. There should be visibility splays of 2.4m x 33m to the north which is blocked by the new fence. Roads state in their 16 th September 2025 response that they would advise the applicant to consider the position of the fence in relation to neighbouring visibility splays and their own visibility splays.”
Officer report
What neighbours said
Two objections raised concerns about the retrospective application, visibility splays, permitted development and the fence being out of keeping.
“Section 6(4) requires that the determination of proposals must be in accordance with the LDP unless material considerations indicate otherwise. Representations Press advertisement and neighbour notification have been carried out in line with the Council's statutory duty. At the time of writing, 2no. third-party objections were received. The following issues have been raised 1. This a retrospective application.”
Officer report
What officers recommended
Officers recommended refusal because the fence reduced visibility splays and was detrimental to road safety under policy AMP 2.
“Figure 3 – Images from the supporting statement of the previous fence at the site which was removed. I consider the fence to be retained is contrary to policy AMP 2 as it is currently blocking the applicant’s and neighbouring dwelling visibility splays so is detrimental to road safety. Other Considerations I have checked the NED, HED and flooding map viewers and the site is not within any other designations.”
Officer report
