Farm dwelling and garage at Approx. 85M E. of No. 10 School Lane, Magherafelt
Summary of planning committee decision
Deferred by Mid Ulster Planning on 3 Mar 2026.
What was proposed
The application proposed a dwelling and garage on a farm, approximately 85 metres east of 10 School Lane.
“LA09/2025/0519/F ACKN Development Management Officer Report Committee Application Summary Committee Meeting Date: March 2026 Item Number: Application ID: LA09/2025/0519/F Target Date: August 2025 Proposal: Proposed site for dwelling and garage on the farm Location: Approx. 85M E. of No.”
“The site of the proposed application is located just outside the settlement development limit of Gulladuff as defined within the Magherafelt Area Plan 2015. The site is located along School Lane with the red line rectangular in shape and part of a larger agricultural field. The roadside site is bound to the south and west by post and wire fencing.”
Officer report
The site and surroundings
The site lies outside Gulladuff’s settlement limit, within a larger agricultural field beside School Lane and near residential development and farm buildings.
“Section 6(4) requires that the determination of proposals must be in accordance with the LDP unless material considerations indicate otherwise. Magherafelt Area Plan 2015 The site is within the countryside and outside the designated settlement limit of Gulladuff. The development limit is sited beyond the north boundary of this application site. The site is within the area of Archaeoligcal potential for Gulladuff.”
Officer report
Officers’ recommendation
Officers recommended refusal because the proposal would add ribbon development along School Lane and cause a detrimental change to rural character.
“…tests set out in criterion (c), the policy is clear that the proposal must also meet the requirements of CTY13 (a-f), CTY14 and CTY16. Policy CTY1 also requires that all proposals for development in the countryside must be sited and designed to integrate sympathetically with their surroundings and to meet other planning and environmental considerations.”
“Reason 2 The proposal is contrary to Policy CTY 8 of Planning Policy Statement 21, Sustainable Development in the Countryside in that the proposal would, if permitted, result in the addition of ribbon development along School Lane.”
Officer report
Consultation and representations
DFI Roads had no objection subject to a condition, DAERA confirmed the farm was active and established, HED was content, and no objections were received.
“Paragraph 1.10 of the SPPS states that any conflict between the SPPS and any policy retained under the transitional arrangements must be resolved in the favour of the provisions of the SPPS. It does not present any change in policy direction with regards to dwellings on a farm or infill dwellings and as such, existing policy will be applied i.e PPS 21.”
“A consultation was sent to DAERA who provided that the farm business ID has been in existence for more than 6 years with the allocation date in 2005. The ID is category one, and the farm business has claimed in each of the last 6 years. The farm business can therefore be considered as active and established for more than 6 years and complies with part (a) of CTY 10. Part (b) relates to any sell offs on the farm holding. DAERA farm maps were submitted showing several fields.”
Officer report
Main planning issue
The proposal met the farm dwelling tests, but officers considered that the ribbon development policy still applied and the site was not a gap site.
“…these lands. The site location outlines lands in blue which were not included within the farm maps with the agent confirming these lands are out in conacre. The lands were checked, and no dwellings or development opportunities have been sold off from the farm holding within 10 years of the date of this application. The application meets criteria (b) of CTY 10.”
Officer report
Committee action
The committee agreed to defer the application for an office meeting earlier in the meeting.
