“Characteristics of the Site and Area The site is located adjacent to Lurgaboy Lane within the settlement limits of Dungannon as defined in the Dungannon and South Tyrone Area Plan 2010. It comprises lands to the southwest and immediately around no 35 Lurgaboy Lane Dungannon, a detached single storey dwelling. These lands, which sit on the corner between Lurgaboy Lane and the entrance into Glenree Avenue, were previously the garden area of no. Lurgaboy Lane.”
“The surrounding area is urban in character with the predominant land use residential. Detached dwellings on individual plots run along the south side of Lurgaboy Lane to the northeast of the site including no. Lurgaboy Lane, which the site runs around, and no. Lurgaboy Lane to the immediate east of the site. Across the road from the site to the north are older style detached dwellings on individual plots.”

“Deferred Consideration: The refusal reasons presented as part of the original consideration, referred to the proposal being contrary to QD 1 of PPS 7 in that it did not comply with criteria (a), (c) and (h). The proposal was also considered contrary to LC1 of the addendum to PPS 7 in that it was not in keeping with the overall character and environmental quality of the established residential area.”
“In relation to criterion (c), the original proposal showed that whilst the total in curtilage level of private amenity space for the northernmost dwelling was above the required threshold, the level of private amenity space provided behind the building line was insufficient. Para. 5.19 of Creating Places states that a minimum of 40 sq. metres is required for individual houses and that it should be provided behind the building line of the house.”
