Dwelling and domestic garage at Approx 160M South of 18 Grange Road, Magherafelt

Summary of planning committee decision

Deferred by Mid Ulster Planning on 5 May 2026.

LA09/2023/0418/ODeferred

What was proposed

Outline permission was sought for a dwelling and domestic garage approximately 160 metres south of 18 Grange Road.

“LA09/2023/0418/O ACKN Development Management Officer Report Committee Application Summary Committee Meeting Date: May 2026 Item Number: Application ID: LA09/2023/0418/O Target Date: July 2023 Proposal: Proposed site for a dwelling and domestic garage Location: Approx 160M South of 18 Grange Road Magherafelt…”

Officer report

Earlier applications and activity

The farm activity evidence covered 2018 to 2025, and earlier permissions included a farm dwelling with revised access and siting.

“This provision will only apply from 25 November 2008; and (c) the new building is visually linked or sited to cluster with an established group of buildings on the farm and where practicable, access to the dwelling should be obtained from an existing lane.”

“I would point out that no receipts / invoices were submitted for 2026, but given the information was only received in mid- February 2026, and in light of the receipts / invoices received, it is likely that the applicant / agent could provide evidence for 2026 if required. Criteria (b) requires that no development opportunities have been sold off from the farm holding in the ten years before the application was received, i.e.”

Officer report

What officers recommended

Officers recommended refusal because the site was not visually linked or clustered with farm buildings and natural heritage impacts had not been demonstrated.

“Criteria (C) of CTY 10 requires the new dwelling to be visually linked or sited to cluster with an established group of buildings on the applicant’s farm.”

“In this case, the proposed site is enclosed by a forested area of broadleaved trees, and if a dwelling was sited within the proposed site, a significant proportion of the trees would need removed to accommodate the dwelling, essentially removing the screening, and the site would be unconnected visually with the existing buildings on the farm.”

Officer report

Main planning concerns

The proposal was considered acceptable for rural character and road safety, but failed requirements concerning farm-site linkage and natural heritage.

“CTY 14 stipulates that planning permission will be granted for a building in the countryside where it does not cause a detrimental change to or further erode the rural character of an area. Policy CTY 14 refers to ribbon development as always being detrimental to the rural character of an area which contributes to a localised sense of build-up and must be resisted unless it meets the specific exceptions outlined under Policy CTY 8.”

“(b) The proposal does not conflict with Policy AMP 3 Access to protected routes. The Grange Road is not a protected route, and DfI Roads are content with the proposed access arrangements subject to the inclusion of a planning condition. I am satisfied that this proposal will not prejudice road safety or significantly inconvenience the flow of traffic.”

Officer report
