06/25/0653/FApproved

What was proposed

The application proposed removing the existing seafood kiosk and erecting a similarly sized replacement with enclosed bin storage.

Officer report

Why officers recommended approval

Officers considered the replacement an improvement in design and appearance that would not harm heritage, residential amenity, flood risk or highway safety.

“In this balance, it is this Officer’s consideration that there is no level of ‘less than substantial harm’ caused by the development, but if the decision maker were to consider there to be a level of harm then it is recommended that any harm would be minimal and the public, and economic, benefit of providing a replacement facility for a small scale business is considered to outweigh any ‘less than substantial’ harm. 13.”

“The Emerging Local Plan includes policy HEC7 and HEC8, which both hold limited weight. These do not introduce any new considerations in terms of amenity and do not supersede the assessment required under adopted policies A1 and R7. It should be noted that comments from Environmental Services are still awaited, and the Committee will be verbally updated once these are received. 14.”

Officer report

Conditions proposed

The recommended conditions would control the use, protect highway safety, maintain awning clearance and require development to follow the approved plans.

“The reason for the condition is :- For the avoidance of doubt of what has been approved and in the interests of proper planning. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), the development hereby permitted shall not be used for any other purposes than those falling within Class E(a) of the Town and Country Planning (Use Class Order) 1987 (as amended), without first receiving the prior…”

“A minimum vertical clearance of 2.4 metres shall be maintained at all times between the lowest part of the awning (when extended) and the level of the adjacent public highway.”
