Summary of planning committee decision
Decided by Erewash Planning Committee on 9 Jul 2025.
What was proposed
Outline permission was sought for three detached dwellings, with access and layout considered now and appearance, landscaping and scale reserved.
“OUTLINE APPLICATION FOR THREE DWELLINGS WITH APPROVAL OF ACCESS AND LAYOUT SOUGHT NOW (MATTERS OF SCALE, APPEARANCE AND LANDSCAPING RESERVED) AT LAND TO THE REAR OF 199 - 213 DERBY ROAD ILKESTON DERBYSHIRE”
“The application seeks outline planning permission for the erection of three detached dwellings on land to the rear of 199 – 213 Derby Road. Matters of access and layout are for consideration now. Matters of appearance, landscaping and scale are reserved.”
Officer report
The site and surroundings
The site was a field with small outbuildings behind existing homes, bordered by trees and the Nutbrook Trail, with access from a private road.
“The application site consists of a field to the rear of Nos. 201 – 213 Derby Road. The field currently contains a number of small outbuildings. A dense band of trees borders the site along the south-western boundary. The Nutbrook Trail runs parallel with the band of trees and the south-western boundary of the site. Vehicular access to the site is via a private access road which passes between Nos. 213 & 215 Derby Road. The driveway to No.213 is taken from the access road.”
“The application site falls within a referral area in relation to historic coal mining activity in the area.”
Officer report
What officers recommended
Officers recommended approval because the site was suitable for housing, the layout could accommodate three homes, and highway safety would not be unacceptably harmed.
“Whilst matters of landscaping, appearance, and scale have been reserved, a site layout plan has been provided to show how the proposed dwellings will be accommodated on site. In relation to location and design, the dwellings would be sited behind existing dwellings on Derby Road, well away from the highway. The site layout plan clearly demonstrates that the site could satisfactorily accommodate three dwellings.”
Officer report
What consultees said
The Highway Authority accepted the amended access and layout, while wildlife, environmental health and mining consultees requested safeguards through conditions.
“DCC Highway Authority – Initial concerns raised regarding the intensification in use of the existing access road and therefore requested that it should be widened to a minimum of 4.1m for the first 15m to allow two vehicles to enter and leave simultaneously. Also requested details of the refuse collection strategy. Noted that satisfactory parking and turning arrangements are proposed for each of the dwellings.”
“Mining Remediation Authority – Concur with the conclusions of the submitted Preliminary Geo-Environmental Risk Assessment (inc. Coal Mining Risk Assessment), that coal mining legacy potentially poses a risk to the proposed development and that intrusive ground investigations are required. No objection subject to the imposition of conditions requiring intrusive investigations and remedial works to be carried out.”
Officer report
Concerns from neighbours
Neighbours raised concerns about wildlife, traffic, pedestrian safety, access conditions, construction disturbance, privacy, outlook, light and possible subsidence.
“The number of cars will increase dramatically and become dangerous to residents of Derby Road trying to reverse off their driveways. • 4 bad accidents in the last 10 years. Proposal will cause an accident black spot. • Pedestrian safety concerns (school children walking to school and crossing the access). • Dust and noise will be a major issue. • Loss of wildlife. Proposed hjousing will destroy animals, wildflowers and insects.”
“Unclear whether the proposals have incorporated any of the proposed mitigations in the environmental or biological reports. Strict conditions will be required. • Concerns regarding increased permanent light pollution. • Consideration should be given to the impact on local residents during construction, such as working hours, noise and increased heavy machinery traffic. • Concern regarding lack of consultation and location of site notices.”

The decision
Permission was approved for three dwellings, with conditions covering reserved matters, access improvements, parking, ground stability, contamination, lighting and biodiversity gain.
“For the reasons outlined above the proposed erection of three dwellings is considered acceptable in principle, and in terms of access and layout. The proposal is not considered to result in unacceptable harm to highway safety. Matters of appearance, landscaping and scale are reserved. Consequently, the application is recommended for approval.”
“Application(s) for the approval of reserved matters must be made not later than three years from the date of the outline permission and the development to which this permission relates must be begun within two years from the date of final approval of reserved matters.”
