Rear garden access gate at 8 Angel Lane, Shaftesbury
Summary of planning committee decision
Decided by Dorset Northern Area Planning Committee on 10 Feb 2026.
The site and surroundings
The home is in a terrace forming part of a Grade II listed building, with its rear garden beside a council-owned car park.
“Angel Lane is located in the centre of Shaftesbury, on a lane just off the High Street. The rear of the site backs on to Angel Lane Car Park, which is Dorset Council owned land. The dwellinghouse is part of a terrace which forms part of the Grade II Listed building 8-12 Angel Lane. It is described in the listing as: C18. 2 storey squared rubble fronts, Nos 8 and 10 have cement slurry finish.”
“Currently, the only access to the property is through the front door, with no access point from the rear. The property does not benefit from any vehicular parking. It is evident that a number of other properties have installed pedestrian access from the rear of their properties which lead into the Angel Lane Car Park, although it is noted than none appear to have included works outside of their property, nor do they lead directly onto a road or parking space. 5.”

Earlier applications
Listed building consent for the same proposal was granted in September 2025, following an earlier invalid application for a rear wall opening.
“The proposed scheme received Listed Building Consent on the application P/LBC/2024/07125 on 29 th September 2025. However, it should be noted that the assessment of this application was purely related to the impact of the proposed development on the listed building, it’s setting and any features of special architectural or historic interest which it possesses.”

The officer recommendation
Officers recommended permission because the development was acceptable in principle, caused no significant harm, and complied with the development plan.
“Planning Assessment Principle of Development Policy 2 of the adopted North Dorset Local Plan sets out that all development proposals should be located in accordance with the spatial strategy for North Dorset, which promotes growth in the 4 main towns. Stalbridge and 18 larger villages. The proposed development site is located within the town of Shaftesbury and is inside of a designated settlement boundary.”
“There are no known climate change implications as a result of this development. Summary of issues and the planning balance • Para 11 of the National Planning Policy Framework (NPPF) sets out that permission should be granted for sustainable development unless specific policies in the NPPF indicate otherwise. • The location is considered to be sustainable, and the proposal is acceptable in its design and general visual, impact. • There would be no harm to heritage assets.”
Officer report
Other requirements
The permission included advice about nesting birds, party wall requirements, and obtaining the council landowner’s permission before works began.
“The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while that nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act.”
“The permission of the landowner should be obtained for the works detailed above and to gain access, if required, onto the landowner's property. For practical purposes, the landowner is Assets and Property, Dorset Council. #”
