Extended restaurant opening hours at 86 - 88 Sidcup, High Street, Sidcup

Summary of planning committee decision

Decided by Bexley Planning Committee on 23 Jul 2026.

25/02152/FULApproved

What was proposed

The application sought to vary opening-hours condition 3, allowing public opening until midnight and outgoing deliveries until 3am every day.

“PROPOSAL Application under Section 73 of the Town and Country Planning Act 1990 to vary con- dition 3 (Opening Hours) of planning permission Ref: 84/00266/FUL for the Change of use to restaurant with single-storey rear extension.”

“This proposal originally sought to alter the opening hours to 6:00am to 3:00am Monday to Sunday, however, these hours have been revised during the application process to the following:”

Officer report

The site and surroundings

The restaurant occupies the ground floor of a three-storey town-centre building with residential accommodation above and nearby mixed commercial and residential uses.

“SITE AND SURROUNDINGS The application site is located on the southern side of the High Street within the Sidcup District Town Centre. The site is situated on a corner plot occupied by a three storey building fronting the High Street. To the rear, the building steps down to a single storey…”

“The immediate area is characterised by a mix of single, two and three storey buildings where predominantly commercial premises occupy the ground floors with residential accommodation commonly being located to the upper floors. The site therefore sits within a mixed use town centre environment, where commercial and residential uses coexist in close proximity.”

Officer report

Noise and neighbouring homes

The assessment found negligible delivery noise effects, but identified plant noise requiring mitigation and concerns about activity during student occupancy periods.

“The assessment found that no significant customer noise was observed during the survey periods, with conversations generally blending into the existing acoustic envi- ronment. The report notes that people noise is inherently unpredictable and subjective; however, based on the observations undertaken, there is no evidence to suggest that customer activity during the extended hours would give rise to anything other than a negligible noise impact.”

“The Council’s Environmental Health Officer has reviewed the submitted Noise Impact Assessment and has not raised any objection to its methodology or conclusions. It has however been acknowledged that Sidcup has a reasonable sized student population which would likely increase the use of dine in and delivery services during the ex- tended operating hours.”

Officer report

Consultation responses

Environmental Health supported revised hours subject to conditions, the Highway Authority had no objections, and the police raised concerns about early-morning moped deliveries.

“No objections subject to the following revised hours: 06:00hrs to 03:00hrs for deliveries 06:00hrs to 00:00hrs for hours of opening to the public…”

“Observed that there may be a potential increase in moped delivery drivers to the lo- cation in the early hours which needs to be seriously considered and the impact that could have on the local community re noise / disturbance etc.”

Officer report

Objections received

Four objections concerned noise, anti-social behaviour, delivery movements, air pollution and whether the late hours suited the character of the area.

“Issue Where addressed in report Potential for people to cluster outside the premises and make noise/cause anti social behaviour People noise and anti-social be- haviour…”

“Additional delivery driver will add to air pollution Other matters Sidcup High Street is a residential high street rather than a late night high street, hours would be out of character with other commercial premises in the area Consideration of Noise Impact Assessment…”

Officer report

Committee discussion

Members discussed the application and requested wording changes to Condition 1 concerning the playing of live or recorded music.

“The Committee discussed the application and noted the report and the Addendum item for this application. During the discussion, Members requested a change to Condition 1 to replace ‘to the playing of...’ with ‘for the playing of...’.”

Minutes

The vote

The committee voted unanimously, 10 votes to none, to approve the application in accordance with the recommendation and Addendum.

“Following their discussion, the Committee RESOLVED on a vote of 10/0 to approve the application in accordance with the recommendation as set out in the report before them, and as amended by the Addendum.”

Minutes

The decision and conditions

Permission was approved with temporary hours, noise and delivery management requirements, and automatic reversion to the previous hours after one year.

“The temporary opening hours shall cease one year from the notified com- mencement date, after which the opening hours of the premises shall revert automatically to those authorised by Condition 3 of planning permission 13/01111/FUL of 6:00am to 11:00pm Monday to Sunday.”

“Reason: To enable the Local Planning Authority to assess the impact of the extended opening hours on the amenities of neighbouring occupiers over a de- fined trial period and to ensure an automatic reversion to the previously ap- proved operating hours in the interests of residential amenity. 3.”
