The site and surroundings
The undeveloped site lies beside an industrial estate, near homes and woodland, with trees, hedgerows and a claimed public right of way.
“The site comprises an irregular shaped parcel of land directly south of Wyndham Street, with the rear gardens of St. Illtyd’s Close along the eastern boundary of the site. To the west and north is Brackla Industrial Estate as designated under policy SP11 whilst to the south/south west is a large area of woodland.”
“The parcel of land is located on a higher banked level above Wyndham Street and is generally flat, with a historical access within the northeast corner, and a claimed Public Right of Way also commencing along the northeastern corner along eastern edge of the site, with a mixture of trees and hedgerow along the perimeter. The area of land is undeveloped, consisting of a mixture of soil and sporadic grassland.”

“RELEVANT HISTORY Application Number: P/18/945/FUL Decision: Refusal Decision Date: 12 September 2019 Proposal: Erection of 41 affordable residential dwellings, with associated on site car parking, access arrangements and associated works…”
Officer report
What officers recommended
Officers recommended permission because the location and land use were acceptable, with conditions addressing visual and residential amenity, highways, drainage, biodiversity and other matters.
“On balance, and having regard to the objections raised, the proposal is deemed to be compatible with neighbouring existing and proposed land uses subject to specific conditions relating to biodiversity.”
“In addition, the development is considered to be appropriate in relation to neighbouring visual and residential amenity, highway safety and drainage, subject to conditions. Any impact upon a claimed PRoW is outside the remit of the Local Planning Authority and can be remedied via other legislation.”
Officer report
What consultees said
Drainage, highways, ecology, contaminated land, Welsh Water, natural resources and fire consultees raised no objections subject to conditions or advice; the rights-of-way response was qualified.
“Shared Regulatory Services – Contaminated Land Section: No objection, subject to conditions relating to contaminated land, aggregates, materials and opening times.”
“Dwr Cymru/Welsh Water: No objection, subject to a condition relating to surface water and advisory notes regarding the water act 1991 and Sustainable Drainage.”
