1.8-metre metal railings at 1 Lower Avenue, Royal Leamington Spa
Summary of planning committee decision
Decided by Warwick Planning Committee on 16 Sept 2026.
What was proposed
Retrospective permission was sought for 1.8-metre-high black metal railings along the site boundary beside Lower Avenue and High Street.
“1 Lower Avenue, Royal Leamington Spa, CV31 3NP Erection of 1.8-metre-high metal railings (retrospective application) FOR The Motoring Centre ----------------------------------------------------------------------------------”
“This application seeks retrospective planning permission for the erection of 1.8- metre-high black metal railings along the boundary of the application site adjacent to Lower Avenue and High Street.”
Officer report
The site
The site is a used car sales premises on a corner plot in Leamington Town Centre and the Royal Leamington Spa Conservation Area.
“The application relates to a used car sales premises which occupies a corner plot at the junction of High Street and Lower Avenue, in Leamington Town Centre. The application site is situated in the Royal Leamington Spa Conservation Area.”
Officer report
What officers recommended
Officers recommended permission because the railings had acceptable design and siting, with no harmful effect on the street scene or conservation area.
“The proposed railings are considered to be of an acceptable design. There are a variety of boundary treatments in the immediate area of similar height to the railings subject of this application. The Conservation Officer has been consulted and has raised no objection to the proposal. Officers are satisfied that the development would not result in harm to the character or appearance of the Conservation Area.”
“Officers are satisfied the siting and design of the railings are acceptable and would have an acceptable impact on the street scene and the Conservation Area. The development therefore accords with the aforementioned NPPF policies and Local Plan policies. NPPF Policy S3 states that decisions on development proposals should apply a presumption in favour of sustainable development.”
Officer report
Consultation responses
The town council and conservation officers raised no objection.
“Royal Leamington Spa Town Council: Raised no objection.”
Officer report
The pedestrian route
Officers acknowledged concerns about reduced footpath width but noted the land was privately owned and one-metre railings could be permitted without planning permission.
“The application site runs adjacent to the public footpath that extends along Lower Avenue and follows the corner round to High Street. On the opposite side of Lower Avenue to the west lies Leamington Train Station. The public footpath adjacent to the application site is therefore subject to high levels of footfall. The railings are sited on land that, whilst under the ownership of the applicant, was retained as open land adjacent to the public footpath.”
“Given the permitted development fallback position of 1 metre high railings in the same location, officers consider a refusal of the railings based on siting alone would be unreasonable in this case.”
Officer report
The committee vote
A motion to grant the application was proposed and seconded before the committee resolved to grant permission.
“96 Following consideration of the report and presentation, it was proposed by Councillor Phillips and seconded by Councillor B Gifford that the application should be granted.”
“Resolved W/26/0497 be granted, subject to the following condition:”
