Statement in support of application for Certificate of Lawfulness existing development (CLUD / LDC1) Site Lands approx. 30m north-north-east of and adjoining 2 Upper Kildress Road Cookstown BT80 9RS Planning History Outline permission was granted under reference LA09/2019/1206/O Decision dated 27 November 2019 for a dwelling and detached domestic garage under CTY10 PPS21. Reserved Matters approval was granted under reference LA09/2020/1539/RM Decision dated 31 March 2021 for the erection of a dwelling and detached domestic garage. Under the standard planning condition attached to outline permissions, development must be begun before the expiration of: 5 years from the date of outline approval, or 2 years from the date of approval of the last Reserved Matters, whichever is the later. Five years from the outline approval expired on 27 November 2024, which is later than the Reserved Matters time limit. Accordingly, the planning permission remained valid until 27 November 2024. Commencement of Development Prior to the expiry of the permission, works were carried out on site forming part of the approved development. These works included: Setting out of the approved garage Excavation of foundation trenches Pouring of concrete foundations Works inspected by Building Control The works were undertaken in August 2024, which is before the expiry date of 27 November 2024. Building Control Confirmation A Building Control Officer from Mid Ulster District Council inspected the foundation trenches. The confirmation letter states that: An inspection of foundation trenches for the garage was carried out on 23 August 2024 The works were satisfactory No further inspection was requested This confirms that operational development had commenced prior to the expiry of the planning permission.
